CITY COUNCIL AGENDA ITEM NO. ;T-- --A-- SUBJECT: -ACQUISITION OF THE SOUTHWESTERLY 7.15 FEET OF 205 39TH STREET. RECOMMENDATION: 1. Authorize the purchase of the southwesterly 7.15 feet of 205 39th Street,.including a 12-foot radius corner cutoff. (The southwesterly 7.15 feet of the northeasterly one-half of Lot 13, Block 139, Canal Section, Newport Beach, plus a 12-foot radius corner cutoff on the southerly corner.) 2. Adopt a resolution accepting a grant deed from Kirk S. Lamb for a portion of 205 39th Street (the southwesterly 7.15 feet of the northeasterly one-half of Lot 13, Block 139, Canal Section, Newport Beach, plus a 12-foot radius corner cutoff on the southerly corner). DISCUSSION: On March 23, 1981, the Council authorized the appraisal of the southwesterly 7.15 feet and a 12-foot radius corner°cutoff for a total of 719.93 square feet of 205 39th Street, owned by Kirk S. Lamb. Attached is the letter from Mr. Lamb requesting that the City purchase the property. Mr. Phillip S. Jackson, MAI, was retained to appraise the property. He concluded that the.fair market value of the parcel as of April 1, 1981, was $42,433. Based on annual increase in property -values of approximately 15%, or 3.7% for 3 months, this value has increased to $44,000 as of July 1, 1981. Mr. Lamb has been offered $44,000, subject to the approval of the purchase by the City Council The location of this lot, as well as other lots owned by the City along Balboa Boulevard, is shown on the attached Exhibit A,and the attached Exhibit B shows the strip of land to be purchased. In September of 1970, the City purchased the lot between Mr. Lamb's. property and Balboa Boulevard. This lot was 17.85 feet wide. The proposed widening of Balboa Boulevard would add 25 feet to the right-of-way width. To maintain this width requires that 7.15 feet of Mr. Lamb's property be acquired. The City presently owns a 25-foot-wide lot across 39th Street from Mr. Lamb's property, and a 32..14-foot-wide lot .behind his property. The area to be acquired currently has a portion of a one -bedroom house on it. If it is occupied by the same tenant at the time the City re- quires the house to be torn down for the widening, the tenant may be eligible for relocation assistance. 0 0 July 14, 1981 Subject: Acquisition of the Southwesterly 7.15 Feet on 205 39th Street Page 2 0 Funds for the purchase of this parcel will come from the Gas Tax Fund in Account Number 183390007, which is budgeted for the acquisition of right-of- way for street widening projects. Lot 12 and �. of Lot 13 Dear City Council: I am the owner of this l and )� R2 lot and have sold it to a builder. (escrow copy enclosed.) When I wanted to build in (1970), I was told that the city intended to widen Balboa Blvd. and would take about 7 feet or 719.93 sq. ft. (a little over 4 of the entire lot). I have been waiting since 1970 for the city to purchase this (see copies of 1970 letters). If the city still wants this land, the cost should be $60,445.32, calculated thusly: Lot sale at $.335,000: Lot size: 95x42 =3,990 s.q.ft.=$.83.96 per sq.ft. The s.q. ft. desired by the city is 719.93 (per letter of 4/27/70) This is a very fair price for the land only. Even though this 7 ft. plus acquisition will result in the demolition of a l bedroom house, the builder intends to tear everything down anyway. So the city only need pay for the land cost and not the loss of a house and/or income from the house.. I hope my buyer will accept the reduction in lot size (with a reduction in price, o: course).
