HomeMy WebLinkAboutF-13 - Acquisition of the Southwesterly 7.15 Feet of 205 39th StreetP '73 BY C;17 FROM: Public Works Department March 23, 1981 CITY COUNCIL AGENDA ITEM NO F-13 SUBJECT: ACQUISITION OF THE SOUTHWESTERLY 7.15 FEET OF 205 39TH STREET (The southwesterly 7.15 feet of the northeasterly one-half of Lot 13, Block 139, Canal Section, Newport Beach) RECOMMENDATION: If desired, authorize staff to retain an appraiser to determine the fair market value of the southwesterly 7.15 feet of 205 39th Street. DISCUSSION: Attached is a letter from Kirk. S. Lamb requesting that the City pur- chase a portion of his property at 205 39th Street. Mr. Lamb first contacted the City in 1970 concerning the planned widening of Balboa Boulevard and how it affected his property. However, this is Mr. Lamb's first letter requesting the City to purchase a portion of his property. In September of 1970, the City purchased the lot between Mr. Lamb's property and Balboa Boulevard. This lot was 17.85 feet wide. The proposed widening of Balboa Boulevard would add 25 feet to the right-of-way width. To maintain this width requires that 7.15 feet of Mr. Lamb's property be acquired. The City presently owns a 25-foot-wide lot across 39th Street from Mr. Lamb's property, and a 32.14-foot-wide lot behind his property. See the attached Exhibit "A" showing City -owned property along Balboa Boulevard. Mr. Lamb has submitted a set of plans to construct a new duplex on his property and requested that an "Approval in Concept" be granted so that he can apply for a Coastal Zone permit. Exhibit B shows his proposed site plan. The plan shows a portion of the building in the proposed right-of-way area for Balboa Boulevard. The building shown will fit within the lot remaining if the .building•is shifted 6.15 feet northeasterly. However, this would eliminate one of his required parking spaces. Some plan modifications would be necessary to provide an added space in tandem in the garage. Mr. Lamb has offered to sell the City 719.93 square feet of property for $60,445.32 based on the $335,000 he has been offered for his whole parcel. It is recommended that the City retain an appraiser to determine if this is the fair market value for the property. In the meantime, if Mr. Lamb wishes to obtain an approval in concept, he can shift the building 6.15 northeasterly and provide one added space in the garage. rk L_ J March 23, 1981 Subject: Acquisition of the Southwesterly 7.15 Feet of 205 39th Street Page 2 If an appraisal of the property is authorized, the appraisal fee of $1,500 to $2,000 would be funded from the budgeted Gas Tax Project for pre- paring EIR's and preliminary plans for future street widening projects. The area to be acquired currently has a portion of a one -bedroom house on it. If it is occupied by a tenant at the time the City acquires the property, the tenant may be eligible for relocation assistance. Benjamin B. Lot 12 and of Lot 13 Dear City Council: I am 'the owner of this 1 and 2 R2 lot and have sold it to a builder. (escrow copy enclosed.) When I wanted to build in (1970), I was told that the city intended to widen Balboa Blvd. and would take about 7 feet or 719.93 sq. ft. (a little over 4 of the entire lot). I have been waiting since 1970 for the city to purchase this (see copies of 1970 letters). If the city still wants this land, the cost should be $60,445.32, calculated thusly: Lot 'sale at .$335,000: tot size: 95x42 =3,990 sq.ft.=$83.96 per sq.ft. The sq. ft. desired by the city is 719.93 (per letter of 4/27/70) This is a very fair price for the land only. Even though this 7 ft. plus acquisition will result in the demolition of a 1 bedroom house, the builder intends to tear everything down anyway. So the city only need pay for the land cost and not the loss of a house and/or income from the house. I hope m;y buyer will accept the reduction in lot size (with a reduction in price, o` course).
