WN T WoC.H NEWPORT BEACH RECREATION DEPARTMENT July 11, 1977 TO: COUNCILMAN ROGERS FROM: PB & R Director SUBJECT: BAY AVENUE LOTS Per your request, Trudi, I am forwarding some information regarding the two lots on Bay Avenue between 18th and 19th Streets. You had several questions regarding these lots and asked me to do a little research. In researching the prior ownerships to the land between 18th and 19th, I could find nothing that indicated that the City had any more land in public ownership than these two lots. They were acquired in 1909 from the Pacific Electric Company, and it appeared that the P.E. owned most of the adjacent land at the same time. In looking through the Council actions in 1909, we could only find the acquisition data, but could not find the reasons for which the property was purchased. As we discussed the other day, one means of being able to sell this property would be to modify the boundaries through a re -subdivision and sell a small portion of the land to the adjacent property owner whose home encroaches onto one of the lots. In doing this, we would end up with a parcel about 2,000 square feet. However, in checking with Mr. Hogan's office, it was determined that this could be a legal - lot size for residential building and could be sold as such. On the other hand, if the lots are retained by the City, the same type of re -subdivision could occur and, rather than selling, the City could develop a mini -park or a boat storage area for our sailing program or some alternate use. Another recommendation that you made was to move the small building from the American Legion site to these lots and use it as a community building for local meetings, lectures, instructional classes, etc. At your suggestion, I re -discussed this subject with the PB & R Commission at its regular meeting of July 5th. After discussion, it was determined that the Commission had no immediate ideas for the use of those lots, but were very definite in their position that the City should not sell them at this time. Z One suggestion that was made at the Commission meeting was that, rather than sell to the two adjacent property owners, the City purchase those properties and increase the size of the public holdings at this location. This appears to give several alternatives to the use of the City -owned lots, but I think it does cover the information that you requested me to obtain. CCS:h F-6
