F-3(d) JUN 12 1989 APPROVED SUBJECT: COAST HIGHWAY WIDENING PROJECT - ACQUISITION OF LEASEHOLD INTEREST FROM DE ANZA NEWPORT MOBILE ESTATES RECOMMENDATIONS: 1. Authorize the City Manager to execute an agreement for acquistion of leasehold interest in real property from DeAnza Newport Mobile Estates for $984,700.00. 2. Authorize the acceptance of a grant deed and quitclaim deed for �y -,3ggy�S the leasehold interest. DISCUSSION: To meet the construction start (now underway) for widening Coast Highway between Bayside Drive and Jamboree Road, the City Council on March 28, 1988, authorized staff to proceed to file eminent domain action with the court against all parties not having accepted the City's offer to that date. Based on a Caltrans approved appraisal with a date of value of January 1, 1987, the sum of $825,795.00 was deposited on behalf of DeAnza, the principal defendant, by the City. DeAnza's counter-offer at that time was approximately $1,350,000. The City's acquisition agent, John Cutler and Associates, has continued to negotiate with DeAnza over the past year. A settlement price of $984,700.00 has been accepted by DeAnza. This price reflects a $158,905.00 increase over the appraisal value, and has Caltrans approval. The higher settlement has been reviewed by Don Drew, the City's con- demnation counsel and meets with his approval. It is recommended that the City Council approve the purchase of the leasehold interest from DeAnza for $984,700.00 under an administrative settle- ment for the following reasons: 1. Council, City's Condemnation, Don Drew, believes that DeAnza could receive higher settlement if suit were to go to trial. 2. City's appraiser, George H. Jones, has expressed a preliminary opinion in a June 1988 report that just compensation has risen 15% from the January 1, 1987, appraisal. The acquisition cost for DeAnza's leasehold interest will be funded from 86% Federal and 14% City Gas Tax monies. Benjamin B. F-18 JAN 9 1989 TO: CITY COUNCIL FROM: Public Works Department SUBJECT: ELECTRICAL SERVICE AT NEWPORT PIER; GRANT OF EASEMENT TO SOUTHERN CALIFORNIA EDISON COMPANY RECOMMENDATION: Authorize the Mayor and City Clerk to execute a Grant of Easement to the Southern California Edison Company. DISCUSSION: As part of the Fisherman's Restaurant construction and other electrical power uses in the Newport Pier area, an Edison Company transformer is required to be placed adjacent to the lifeguard headquarters. Because of Company policy and Public Utilities Commission Regulations the transformer and its appurtenances must be located on or within a recorded easement. The size of the required easement is 15 feet by 115 feet. The electrical conduit and wiring have already been installed as part of the restaurant construction contract. The transformer will be installed by the Edison Company once the easement has been executed. A concrete block screen wall will be constructed around the transformer and the adjacent meter panel as part of the lifeguard headquarters remodeling. The electrical services for the new restroom, the pier lighting, the dory fishing fleet and the lifeguard building will also be located behind the new screen wall.
