LM2018-004) RESOLUTION NO. 2023-55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, SUMMARILY VACATING A PORTION OF A PUBLIC SEWER EASEMENT AT 850 SAN CLEMENTE DRIVE (PARCEL 1 OF LOT MERGER NO. LM2018-004) WHEREAS, the City Council ("City Council") of the City of Newport Beach ("City"), pursuant to Chapter 4 of the Public Streets, Highways and Service Easements Vacation Law, Section 8330 et seq. of the California Streets and Highways Code, is authorized to summarily vacate a public service easement when the easement has not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding the proposed vacation; the date of dedication or acquisition is less than five years, and more than one year, immediately preceding the proposed vacation and the easement was not used continuously since that date; or the easement has been superseded by relocation, or determined to be excess by the easement holder, and there are no other public facilities located within the easement, WHEREAS, the property owner of 850 San Clemente Drive ("Property") has requested the City vacate a section of a 15-foot public sewer easement ("Easement"), which section is legally described in Exhibit "A" and shown in Exhibit "B", from the Property, with another section of the Easement, also shown in Exhibit "B," to remain; WHEREAS, the segment of the 8-inch sewer main in the section of the Easement proposed for vacation was abandoned in place as part of the Vivante Newport Center project, there are no active City facilities in that section of the Easement, and thus that section of the Easement is unnecessary for future sewer purposes; and WHEREAS, the City Council, having reviewed and considered the various elements of the City's General Plan with respect to the proposed summary vacation of the specified section of the Easement, has determined that the proposed summary vacation is consistent with the General Plan. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby summarily vacate the section of the Easement described in Exhibit "A" and shown in Exhibit "B" as the sewer easement area to be vacated on the grounds that the portion of the Easement is excess and there are no other public facilities therein. Section 2: The City Clerk is hereby directed to record this resolution in the office of the Orange County Recorder in accordance with Section 8336 of the California Streets and Highways Code. Resolution No. 2023-55 Page 2 of 3 Section 3: That from and after the date the resolution is recorded, the portion of the Easement described in Section 1 no longer constitutes a public service easement. Section 4: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 5: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 6: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
