ORDINANCE NO 1052`
AN ORDINANCE OF THE CITY OF
NEWPORT BEACH AMENDING SEC-
TION 9103.495 OF THE NEWPORT
REACH MUNICIPAL CODE RELAT-
ING TO YARD REQUIREMENTS IN
C.0 DISTRICTS
The City Council of the City of New-
port Beach does ordain as fellows:
SECTION 1. Section 9103.495 of the
Newport Beach Municipal Cade is amend-
ed to read:
"SECTION 910.495. Yards Required.
(a) Front yards: Except as may be
indicated on the Districting Maps: no
front yards shell he required; provided,
however, that where the frontage in a
block is partially In an 'R' District,
the front yard shall be the same u
required in such R' District.
(b) Side yards: For buildings in ox-
Cass of three (3) stories.ln height, which
are designed eXClusively for uses other
then residential, there shall be a side
Yard on each side of the building, be-
glif ing with the fourth story, of not
less than five (5) feet. Said side yards
shall be increased In width a distance
equal to two (2) per cent of the average
width 0 fat for each story in excess
of four (4). In ad event, however, Shan
a side yard of more than fwenty -five
(25) feet be required.
For buildings designed to be used in
whale or in part for residential purposes,
there shall be a side yard on each
side of the building, beginning with tho
first story used in whole or in part for
residential purposes, of net less than
flve (5) feet, increasing In width there
after a distance equal to two (2) per
cent of the average width of the lot
for each story above said first story
used for residential purposes. In no
'event, however, shall a sloe Yard of
more than twenty-five (251 feet be re-
qulred.
Where the shop of a lot abuh. the
side line of a lot In an 'R' District, Me
aforementioned requirements shell apply
for the aide yard abutting the 'R' Disl-
rlct at the ground level for all bul R➢nae.
(c) Rear yards: None, except where
the rear of a lot abuts on an R' District,
In which case the rear yard shall be
net less than five (5) feel.
(d) Rear yards abutting on egeys:
Minimum ten (10) feet."

This ordinance was introduced at
regular meeting of the City Council of
the City of Newport Beach held art the
12th day of August, 1963, and was adopt -
ad on the 26th day of August, 1963, by the
following veto, to wit
