State of California ORDINANCE NO. 1103 AN ORDINANCE OF THE CITY OF N E W P O R T BEACH REPEALING CHAPTER 3 OF ARTICLE 111 OF THE NEWPORT BEACH MUNICIPAL CODE AND ADDING A NEW CHAP- TER 3 TO ARTICLE III OF SAID MUNICIPAL CODE RELATING TO THE LICENSING OF BICYCLES The City Council of the City of New. Port Beach does ordain as follows: SECTION 1. Chapter 3 of Article 111 of the Newport Beach Municipal Code is repealed. SECTION 2. A new Chapter 3 is added to Article 111 of the Newport Beach Municipal Cade to read: "Chapter 3 BICYCLES SECTION 3300. Bicycle Licenses and Exception. (a) EYerY owner or Person having charge or control of a bicycle shall obtain a license for the same from the City. (b) Exception. There are excepted from the licensing Provisions of this chapter new bicycles Included within the stock of a dealer in bicycles. SECTION 3301. Using or Renting Bi. cycles Without Current License Prohibit. ed. No Person shall use any bicycle or rent any bicycle for use upon the Public streets or Public Places in the City without the same being licensed as Pro - Yided for in this chapter and haying the current license decal or Plate issued pursuant to this chapter displayed there- on. SECTION 3302. Issuance of License. (a) The Chief of Police or his duly au- thorized agent shall issue bicycle II- censes upon written application on a form Prescribed by the City accompanied by the fee Prescribed in this chapter. The Chief of Police may designate as his duly authorized agent any Person holding a Yalld business license to engage in the business of buying or selling bicycles or bicycle frames within the City. (b) Upon Payment of the required fee, there shall be Issued to the appli. cant a license decal or Plate and a cor- responding receipt bearing the same number, the Irome of the applicant, the frame number of the bicycle, and such other Information as may be required by the Chief of Police. Such license de. cal or Plate shall be immediately per- manently affixed to the frame or under the seat of such bicycle ark shall at all times during the current registration pe- riod remain attached thereto. If such license decal or Plate is Issued by a It. censed dealer in bicycles or bicycle frames, he shall forward to the Police Department within 24 hours of the date Of such Issuance a duplicate of such receipt send the fee collected for such license. i (c) The:Chief of Police shall keep a record of leach bicycle license issued, such record to Include the licensee's name, the :number of the license decal or Plate -and Its date of Issuance, the frame number of the bicycle, and such other Information deemed to be neces- as" by' the Chief of Police. SECTION 330.1. License Period and Fees. (a) The licenses required under this -chapter shall be Yalld for a flye. Year Period commencing on January 1, 1965, and ending on December 31, 1969, and for successlye five�Year Periods thereafter. (b) The fee for such licenses shall be one dollar and fifty cents ($1.50) for each license Issued during the first four Years of MY license Period and fifty cents (5.50) for each license Issued during the fifth Year thereof. SECTION 3304. Transfer -Report Re. quired. EYerY Person who sells or trans- fers ownership of any bicycle or bi- cycle frame shall, within five (5) days of the date M such sale or transfer, report the same by returning to the Chief of Police the receipt Issued to such Person as licensee thereof, together with the name and address of the Person to whom said bicycle or bicycle frame was sold Or transferred. EYerY Pur- chaser or transferree of any such bi- cycle or bicycle frame shall apply for a transfer of license within five (5) days of such sale or transfer. SECTION 3305. Dealers and Junk Dealers —Report of Purchases. EYerY Per- son engaged in the business of buying secondhand bicycles or bicycle frames and every junk dealer who purchases or otherwise acquires any bicycle or bi- cycle frame as lank, or otherwise, shall report to the Chief of Police in writing within 24 hours thereafter. specifying: 1. The name and address of the person from whom each such bicycle or bicycle frame was Purchased or otherwise acquired. 2. The description of such bicycle or bicycle frame Purchased or otherwise acquired. 3. The frame number thereof. 4. The number of the license decal or Plate found attached thereto, if any. SECTION 3306. Dealers and Junk Dealers • Report of Sales. In addition to any other reports required by the Provisions of this Code, all Persons en. gaged in the business of selling new or secondhand bicycles or bicycle frames are hereby required to make a report to the Chief of Police concerning all such bicycles or bicycle frames sold for which a bicycle license Is not Issued at the time of sale. Such report shall be made In writing within 24 hours of the data of sale and shall specify: 1. The name and address of the Person to whom each such bicycle or bicycle frame was sold or otherwise disposed of. 2. The description of such bicycle or bicycle frame sold or otherwise dis- Posed of. 3. The frame number thereof. 4. The number of any PraYl0U51Y is, sued license decal or Plate found at- tached thereto. SECTION 3307. Period of Time to Elapse Before Sale. No Pawnbroker, sec ondhand dealer, or lank dealer shall sell or otherwise dispose of any bicycle or bicycle frame within 21 days after such article has been Purchased or received by such Pawnbroker, second. hand dealer or funk dealer. SECTION 3308. Removal of Numbers. No Person shall willfully remove, des- troy, mutilate or alter the number of any bicycle or bicycle frame either II- ceased or unlicensed. This section, how- ever, shall not Prohibit the Chief of Po- lice from stamping nulllbers on the frames of bicycles on which no serial number can be found or on which the serial number is Illegible or insufficient for Identification Purposes. SECTION 3,j09. Destruction of Bicycle License Deco s or Plates. No Person shall willfully remove, destroy, mutilate or alter any bicycle license decal or Plate during the time In which such decal or Plate Is operative. SECTION 3310. Lost or Stolen Li. came Decals or Plates. In the event the license decal or Plate shall be lost or stolen from any bicycle, the owner or Person having charge or control of such bicycle shall Immediately notify the Chief of Police of the loss of the same and, when such owner or Person having charge or control of such bicycle Pays a fee of twenty-flve cents (5.25) and makes Moser MfldaYit of the loss of said license decal or Plate, stat- ing the facts of said loss as nearly as Possible, a new license decal or Plate shall be issued to such owner or Person. SECTION 3311. Report of Theft or Loss to Police Department. EYerY owner or person having charge or control of any bicycle shall Immediately notify the Police Department of the loss by theft or otherwise of any such bicycle." SECTION 3. This ordinance shall be Published once in the official newspaper of the City, and the same shall be effective 30 days after the date of Its adoption.
