ORDINANCE NO. 1179
AN ORDINANCE OF THE CITY OF NEWPORT BEACH
REPEALING SECTION 3.08.030 OF, AND ADDING A
NEW SECTION 3.08.030 T0, THE NEWPORT BEACH
MUNICIPAL CODE TRANSFERRING PROPERTY TAX
DUTIES TO THE COUNTY
PREAMBLE: WHEREAS, on the 29th day of September, 1952,
the City Council of the City of Newport Beach adopted Ordinance
No. 674 providing for the transfer to the County of Orange of the
assessment, equalization and collection of City property taxes by
which Section 2602 was added to the 1949 Newport Beach Municipal
Code and was subsequently recodified in the 1966 Municipal Code as
Section 3.08.030; and
WHEREAS, at the time Ordinance No. 674 was adopted, the
City of Newport Beach was a general law city; and
WHEREAS, on January 7, 1955, the City of Newport Beach
became a chartered city in accordance with the provisions of
Section 8 of Article 11 of the Constitution of the State of Cali-
fornia; and
WHEREAS, Ordinance No. 674 was adopted pursuant to the
authority for transfer of city tax functions as provided in
Article 1, Chapter 2, Division 1, Title 5, of the Government Code
of the State of California; and
WHEREAS, Article 2, Chapter 2, Division 1, Title 5, of
the Government Code of the State of California provides for an
alternative method applicable to chartered cities whereby the trans-
fer of city tax functions to a county may be accomplished; and
WHEREAS, the City Council wishes to utilize the alterna-
tive method for transfer by chartered cities of city tax functions
to a county as provided in said Article 2 by repealing Section 2602
added to the 1949 Newport Beach Municipal Code by Ordinance No.

674, as recodified in the 1966 Municipal Code as Section 3.08.030,
and enacting a new Section 3.08.030 transferring said city tax
functions pursuant to the authority of said Article 2;

NOW, THEREFORE, the City Council of the City of Newport
Beach does ordain as follows:
SECTION 1. Section 3.08.030 of the Newport Beach Muni-
cipal Code is repealed.
SECTION 2. A new Section 3.08.030 is added to the New-
port Beach Municipal Code to read:
"3.08.030 Pro ert Tax Duties Transferred to County.
Pursuant to t e prow s ons o rtic e Z. chapter 2. Division
1, Title 5, of the Government Code of the State of California,
the City of Newport Beach hereby elects that the following
duties be performed by the appropriate officers of Orange
County:
(a) The assessment of City property for City taxes.
(b) The equalization and correction of the assessment
of City taxes.
(c) The collection, payment, and enforcement of the
City taxes, including delinquent taxes.
(d) The redemption of property from sale or other
penalty for nonpayment of City taxes."
