AN ORDINANCE OF THn CITY OF NEWPORT BEACH
ADDING CHAPTER 5.75 TO THE NEWPORT BEACH
MUNICIPAL CODE REGULATING ROLLER SKATE
RENTAL ESTABLISHMENTS
WHEREAS, the City Council finds that roller skating
on the public streets, sidewalks, and rights of way within the
City of Newport Beach has become ,a very popular activity; and
WHEREAS, considerable conflict exists betwe6U the
use of the public rights of way for roller skating, walking,
bicycling, and the'like; and.
WHEREAS, roller skate rentals contribute significantly
to the number of roller skate users of said public rights of
way; and
WHEREAS, considerable public disturbances created by
users of rented roller skates in the late night and early
morning hours; and
WHEREAS, in the interest of public health,.safety,
morals, and general welfare, it is appropriate to limit the
hours of operation of roller skate rental establishments to
thereby reduce or eliminate the late roller skate use on the
public rights of way,
NOW, THEREFORE, the City Council of the City of
Newport Beach DOES ORDAIN as follows:
SECTION 1. Chapter 5.75 is added to the Newport
Beach Municipal Code to read as follows:

Sections:
5.75.010 Purpose.
5.75.020 Definitions.
5.75.030 Hours of Operation.
5.75.010 Purpose. The City Council of the City
of Newport Beach hereby finds and declares that roller skating
rental establishments provide a unique recreational opportunity
to the City of Newport Beach, but that uncontrolled rental

of roller skates creates.a hazard and threat to the public,
safety, and welfare by uncontrolled operation which adds to
the conflict between roller skaters, pedestrians, and bicyclists.
• The purpose of this ordinance is to improve safety and to pro-
vide benefits to the public welfare by controlling the hours
of operation of roller skate rental establishments.
5.75.020 Definitions. For the purposes of this
chapter, the following words and phrases shall be construed to
have the meanings herein set forth, unless it is apparent from
the context that a different meaning is intended:
(a) Roller Skate Rental Establishment: A roller
skate rental establishment shall mean a retail place of busi-
ness engaged in the rental of roller skates, regardless if
such establishment is engaged in the business of roller skate
rentals as a primary or as an incidental operation.
(b) Roller Skate: Roller skate shall mean any
form of device worn on the feet with wheels or rollers, for
use on a sidewalk, street, or any other surface offering
traction.
5.75.030 Hours of Operation: Roller skate rental
establishments may be operated only between the hours of 8:00 a.m.
and 10:00 p.m. on any day. If the roller skate rental establish-
ment is part of another business, the roller skate rental
portion of the business may not be conducted beyond the hours
set forth hereinabove.
SECTION 2. This ordinance shall be published once
in the official newspaper of the City, and the same shall be
effective thirty (30) days after the date of its adoption.
This ordinance was introduced at a regular meeting
of the City Council of Newport Beach, held on the 10th day
of July 1979, and was adopted on the 23rd
10 day of July , 1979, by the following vote,
