AN ORDINANCE OF THE CITY OF NEWPORT BEACH
ADDING SECTION 12.57.027 TO THE NEWPORT BEACH
MUNICIPAL CODE RELATING TO REGULATION TO
ROLLERSKATING
WHEREAS, the City Council finds that rollerskating
upon the public streets, sidewalks, and rights -of -way within
the City has become a very popular activity involving considerable
numbers of persons; and
WHEREAS, within the public streets and rights -of -way:_
used'by rollerskaters and pedestrians, there is but limited
space and there arises a conflict between the demands for space
between pedestrians and rollerskaters; and
WHEREAS, it is-necessary to protect rollerskaters and
pedestrians from conflict at certain times and locations within
the City to protect the safety of each group; and
WHEREAS, the City Council finds that the primary
purpose for sidewalks is for the use of pedestrians and
that to protect this primary use, certain regulation on the
activity of rollerskaters must be enacted; and
WHEREAS, many of the streets and rights -of -way used
by rollerskaters are adjacent to residential areas; and
WHEREAS, the large and increasing number of roller-
skaters on the public streets, sidewalks and rights -of -way within
the City of .Newport. Beach in residential areas creates and main-
tains a nuisance due to noise and rowdiness caused by the large
number of rollerskaters using same; and
WHEREAS, said nuisance interferes with the quiet comfort
and enjoyment of said residential properties and substantially
interferes with the rest and repose of the persons residing therein
when the conduct occurs, in the night and early hours; and
WHEREAS, the impact upon the residents by large numbers
of rollerskaters substantially interferes with the comfortable
enjoyment of life and property; and
WHEREAS, it is in the interest of the public health,
safety, morals, and general welfare to establish limits on the
hours and locations where rollerskaters may use public streets,
4f rights -of -way, and sidewalks for rollerskating activities,
NOW, THEREFORE, the City Council of the City of
Newport Beach DOES ORDAIN as follows:
SECTION 1. Section 12.57.027 is added to the Newport
Beach Municipal Code to read as follows:
"12.57.027 Rollerskating Restrictions- Location and
Hours. Rollerskating shall be prohibited on such public
streets, sidewalks, and rights -of -way within the City of
Newport Beach during those hours.and at those locations which
are declared by resolution of the City Council to be locations
where rollerskating is prohibited."
SECTION 2. This ordinance shall be published once in
the official newspaper of the,City, and the same shall be effec-
tive thirty (30) days after the date of its adoption.
This ordinance was introduced at.a regular meeting of
the City Council of.the City of Newport Beach held on the 10th
day of Sept 1979, and was adopted on the
1st day of October , 1979, by the
following vote, to wit:
