AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING SECTION 5.13.030 OF THE NEWPORT
BEACH MUNICIPAL CODE TO REQUIRE THAT THE
OFFICIAL POLICE TOW TRUCK OBTAIN A CERTI-
FICATE PURSUANT TO CHAPTER 5.15 OF THE
NEWPORT BEACH MUNICIPAL CODE
WHEREAS, Chapter 5.13 of the Newport Beach Municipal
Code sets forth Tow Truck Regulations; and
WHEREAS, Chapter 5.15 of the Newport Beach Municipal
Code sets forth Regulations for the Official Police Tow Truck
Service; and
WHEREAS, Section 5.13.030(A) exempts the Official
Police Tow Service from the requirements of a certificate; and
WHEREAS, Section 5.15.070 requires that the Official
Police Tow Truck Service have a certificate-pursuant to
Chapter 5.13 of the Newport Beach Municipal Code; and
WHEREAS, it is the desire of the City Council to
end the conflict between said Chapters and to require that the
Official Police Tow Truck Service obtain a certificate pursuant
to Chapter 5.13 of the Newport Beach Municipal Code,
NOW, THEREFORE, BE IT ORDAINED as follows:
SECTION 1. Section 5.13.030 of the Newport Beach
Municipal Code is .hereby amended, by deleting subdivision (A)
therefrom and renumbering subdivision (B) to (A) and subparagraph
(C) to (B), to read as follows:
"5.13.030 Exceptions. The requirements of this
Chapter shall not apply to:
(A) Tow truck operators who are rendering assis-
tance in the case of a major catastrophe or emergency
• which the official police tow truck operators are
inadequate or unable to handle.
(B) Tow truck operators not operating in the
City but who are called upon to tow vehicles from

outside City boundaries and deposit said vehicles in
the City."
SECTION 2. This ordinance shall be published once
in the official newspaper of the City, and the same shall be
effective thirty (30) days after the date of its adoption.
This ordinance was introduced at a regular meeting
of the City Council of the City of Newport Beach held on the
23 day of October
on the 12th day of
