AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING SECTION 6.04.080 OF THE NEWPORT BEACH
MUNICIPAL CODE DEFINING THE RESPONSIBILITY FOR
PROVIDING CONTAINERS FOR DEPOSIT OF GARBAGE
AND REFUSE
WHEREAS, Section 6.04.080 of the Newport Beach
Municipal Code sets forth the responsibility of certain persons
to provide containers for the deposit of garbage and refuse; and
WHEREAS, certain ambiguities exist in said Section
which ambiguities should be eliminated,
NOW, THEREFORE, the City Council of the City of Newport
4 Beach DOES ORDAIN as follows:
SECTION 1. Section 6.04.080 of the Newport Beach
Municipal Code is hereby amended to read as follows:
"6.04.080 Responsibility for Providing
Containers. Every owner, occupant, manager or
person in control of the premises of any dwelling
unit or units, or of any place of business or
institution within the City where garbage and /or
refuse accumulates, shall provide or cause to be
provided a sufficient number of containers to
accommodate all refuse and /or garbage accumulated
on the premises between collection days. The
owner, occupant, manager or person in control of
the premises shall be jointly and equally respon-
sible for providing the required number of con-

tainers, and upon the failure to do so, the owner,
occupant, manager or person in control of the
premises shall comply with the requirements of
this Section within five (5) days after receiving
notice so to do. Failure of the owner, occupant,
manager or person in control of the premises to
provide the required containers within the time
set forth in the notice so to do shall constitute
an infraction."
SECTION 2. This ordinance shall be published once in
the official newspaper ofthe City and the same shall be effective
thirty (30) days after the date of its adoption.
