AN ORDINANCE OF THE CITY OF NEWPORT BEACH
AMENDING CHAPTER 20.02 OF THE NEWPORT BEACH
• MUNICIPAL CODE BY ADDING SECTION 20.02.090 TO THE
CITY'S HEIGHT LIMITATION ORDINANCE SPECIFYING
AIRPORT LAND USE COMMISSION REVIEW OF ALL PROJECTS WHICH
WOULD REQUIRE FEDERAL AVIATION ADMINISTRATION NOTIFICATION
follows:
The City Council of the City of Newport Beach DOES ORDAIN as
Section 20.02.090 is hereby added to the Newport Beach
Municipal Code to read as follows:
20.02.090 Airport Height Limits. Any project which requires
a notice of construction or alteration by the Federal
Aviation Administration Regulations Part 77 shall require
FAA compliance, and the applicant shall submit a copy of the
FAA application to the Airport Land Use Commission (ALUC)
and provide the City with FAA and ALUC responses. If the
ALUC requests review of the project, then the project shall
be submitted to the Commission by the City. Commission
determination shall be referred to the City within 60
calendar days from the date of referral of the application
to the ALUC, and shall be considered before the City takes
any action on the project. If the Commission fails to refer
• the determination within that period, the proposed project
shall be deemed consistent with the Airport Environs Land
Use Plan (AELUP).

This Ordinance was introduced at a regular meeting of the
City Council of the City of Newport Beach held on the 9th day of
September, 1985, and was adopted on the 23rd day of September ,
1985, by the following vote:
