HomeMy WebLinkAbout92-49 - Amending A Portion of Districting Map No. 14 So as to Reclassify the Proposed Fire Station Property Located At 124 Marine Avenue from the C -1 (Light Commercial) District to the GEIF (Governmental, Educational and institutional Facilities) DistricORDINANCE NO. 92 -49 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING A PORTION OF DISTRICTING MAP NO. 14 SO AS TO RECLASSIFY THE PROPOSED FIRE STATION PROPERTY LOCATED AT 124 MARINE AVENUE FROM THE C -1 (LIGHT • COMMERCIAL) DISTRICT TO THE GEIF (GOVERNMENTAL, EDUCATIONAL AND INSTITUTIONAL FACILITIES) DISTRICT. (PLANNING COMMISSION AMENDMENT NO.750) WHEREAS, Section 20.84.010 of the Municipal Code of the City of Newport Beach provides that Title 20 (the Zoning Code) may be amended by changing the zoning designation of Districts and other provisions whenever the public necessity and convenience and the public welfare require such amendment; and WHEREAS, Section 20.84.020 of the Municipal Code of the City of Newport Beach provides that an amendment to Title 20 may be initiated by resolution of intention of the Planning Commission; and •WHEREAS, the Planning Commission has recommended to the City Council the adoption of General Plan Amendment No. 89 -2(H) and Local Coastal Program Amendment No. 19 so as to change the land use designation of the subject property from 'Retail and Service Commercial" to "Governmental, Educational and Institutional Facilities'; and WHEREAS, land use decisions are legally required to be consistent with the City's General Plan and Zoning; and WHEREAS, the City desires to make the zoning districts of property in the City of Newport Beach consistent with the Land Use Element of the General Plan; and WHEREAS, in conjunction with the consideration of the above referenced amendments to the General Plan and Local Coastal Program the City has prepared an • Initial Study pursuant to the requirements of CEQA for this action; and WHEREAS, based upon the information contained in the Initial Study, comments received, and all related documents, there is no substantial evidence that the project, as conditioned or as modified by mitigation measures identified in the Initial Study, 1 could have a significant effect on the environment, therefore a Negative Declaration has been prepared. The Negative Declaration adequately addresses the potential environmental impacts of the project, and satisfies all the requirements of CEQA, and is therefore approved. The facts and findings relied upon in making this determination are contained in the public record, and include the following: • 1. Evidence presented by staff and area residents demonstrates that the neighborhood surrounding the proposed fire station site at 124 Marine Avenue is currently subject to relatively high ambient noise levels due to heavy traffic, including frequent truck deliveries to nearby commercial establishments and visitors. 2. A land use survey revealed that many residential properties are located in the Marine Avenue commercial district near the existing fire station at 323 Marine Avenue, and therefore any increase in noise and • congestion that would result from the relocation of the fire station to 124 Marine Avenue would be at least partially offset by reduced impacts in the vicinity of the existing fire station. 3. The mitigation measures and conditions of approval that have been applied to the project will substantially reduce impacts in the areas of noise, traffic and circulation, aesthetics, light and glare, and human health. 4. In the context of the existing surroundings, and in consideration of the mitigation measures and conditions of approval applied to the project, • the City Council has determined that there is no substantial evidence that the potential increase in noise and traffic that would result from the relocation of the fire station to 124 Marine Avenue could have a significant adverse effect on the environment; and 2 WHEREAS, the Negative Declaration reflects the independent judgement of the City Council and was reviewed and considered prior to approval of the project; and WHEREAS, pursuant to Section 20.84.30, the Planning Commission has recommended that the City Council approve Amendment No. 750 to Title 20 of the Newport Beach Municipal Code amending Districting Map No. 14; and • WHEREAS, pursuant to Section 20.84.050, the City Council has held a duly noticed public hearing to consider Amendment No. 750 to Title 20 of the Newport Beach Municipal Code amending a portion of Districting Map 14. THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN, AS FOLLOWS: SECTION 1. Districting Map No. 14 is hereby amended for the property located at 124 Marine Avenue, on the southeast comer of Marine Avenue and Park Avenue, more particularly described as Lots 17 and 18, Block 2, Section 4, Balboa Island, to reclassify this property from the C -1 (Light Commercial) District to the GEIF (Governmental, Educational and Institutional Facilities) District. SECTION 2. The Planning Director of the City of Newport Beach is hereby directed to change Districting Map No. 14 referred to in Section 20.01.050 of the Newport Beach Municipal Code and by such reference made part of Title 20, to reflect the changes described in Section 1 (above), and when said Districting Map has been so amended, the same shall be in full force and effect and be part of Title 20 of the Newport Beach Municipal Code. SECTION 3. The Mayor shall sign and the City Clerk shall attest to the • passage of this Ordinance.
