Pursuant to the provisions of Sections 50022.1 through 50022.5, of the Government Code of the State of California, there is hereby adopted and incorporated by reference into this chapter, that certain Code entitled "Uniform Fire Code," (1994 Edition) referred to in this chapter as the "Fire Code" specifically including Appendices, Division I through Division VI, save and except such portions as are hereafter deleted, added or amended. One (1) certified copy of which is to be on file in the office of the City Clerk of the City of Newport Beach and open for public inspection. 9.04.020 Amendment to Section 103.2.1.2 of the Uniform Fire Code. Section 103.2.1.2 of the Fire Code is amended by adding the following subsection: "Section 103.2.1.3 Sworn members of the Newport Beach Fire and Marine Department shall have the power to issue citations for violations of the Fire Code." 9.04.030 Amendment to Section 105 of the Uniform Fire Code. Section 105 of the Fire Code is amended by adding Section 105.2.1.1 to read as follows: "Section 105.2.1.1. Fees. The Newport Beach City Council shall establish by resolution, and from time to time amend, fees for the administration of this Chapter. Fees required by this Chapter shall be in addition to those required by any other Chapter of this code." 9.04.040 Amendment to Section 902.2.2.1 of the Uniform Fire Code. Section 902.2.2.1 of the Fire Code is amended adding the following text: "Section 902.2.2.1. In the area of fire hydrants, the width shall be increased to 26 feet. (The minimum width of a gate or opening that fire apparatus would be expected to use shall be not less than 14 feet unobstructed. Tliis minimum width may be increased depending on the length of the approach.)" 9.04.050 Amendment to Section 902.4 of the Uniform Fire Code. Section 902.4 of the Fire Code text is deleted and added to read as follows: "Entrance Gates /Chains. All emergency vehicle access gates, private gated communities, chains across fire lanes, and gates that provide access to the beach and /or wildland areas, shall have a lock approved by the Fire Chief. Where gates are electrically operated, an approved fire department key switch and an approved strobe light receiver shall be installed and tested by the fire department." 9.04.060 Amendment to Section 902.4 of the Uniform Fire Code. Section 902.4 of the Fire Code is amended by adding Section 902.5 as follows: "Section 902.5 Key Box System. Key box shall contain two sets of the following: 1. Keys to locked points of ingress whether on the interior or exterior of the building. 2. Keys to locked mechanical equipment rooms. 3. Keys to locked electrical rooms. 4. Keys to elevator controls. 5. Keys to other areas as directed by the Chief." K 9.04.070 Amendment to Section 1001 of the Uniform Fire Code. Section 1001.5.3 of the Fire Code is amended by adding subsection 1001.5.3.1 to read as follows: "Section 1001.5.3.1 Provide and install electrical outlets (120 volt, duplex) that are connected to the emergency generator circuitry /system, when generator is required by 403.8.1 of the Uniform Building Code, in the following locations: 1. In the main exit corridor of each floor, adjacent to each exit enclosure. 2. In each elevator lobby. 3. In public assembly areas larger than 1,500 square feet. • 4. In every fire control room. 5. In such other areas as may be designated by the Chief. Outlets shall be RED in color." 9.04.080 Amendment to Section 1005 of the Uniform Fire Code. Section 1005 of the Fire Code text is deleted and added to read as follows: "Section 1005 Automatic Fire Sprinklers. An automatic fire - extinguishing system shall be installed in the occupancies and locations as set forth in this section. Notwithstanding any applicable provisions of this code, an automatic fire - extinguishing system shall be installed in all occupancies when the total floor area of a building, regardless of area separation walls or allowable area, exceeds 5,000 square feet. 1. In all existing structures not equipped with an automatic fire - extin - guishing system, when additions cause the structure to exceed 5,000 square feet the following provisions apply. A. When such additions are 25% or less than the original building square footage, the existing structure and the addition need not be equipped with an automatic sprinkler system. B. When such additions exceed 25% but are less than 50% of the original building square footage, the addition shall be equipped with an automatic sprinkler system. •C. When such additions are 50% or more of the original building square footage, the entire structure shall be equipped with an automatic sprinkler system throughout. 2. In all existing structures not equipped with an automatic fire - extin - guishing system that exceed 5,000 square feet, the following provisions shall apply. A. When additions are 1,250 square feet or less, the existing structure and the addition need not be equipped with an automatic sprinkler system. B. When additions exceed 1,250 square feet but are less than 2,500 square feet, the addition shall be equipped with an automatic sprinkler system. C. When additions are 2,500 square feet or more, the entire structure shall be equipped with an automatic sprinkler system throughout. 3. Except in Group R, Division 3 and Group M occupancies, in partially sprinklered buildings, sprinklered areas shall be separated from nonsprinklered areas. Such separation shall not be less than that required for a one -hour occupancy separation. 4. Automatic fire sprinklers shall be installed in all buildings having floors used for human occupancy located more than 40 feet above the lowest level of Fire Department access. 5. For provisions on special hazards and hazardous materials, see Section 1003 and Parts V, VI and VII of the Uniform Fire Code." •"Section 1005.1 System Design. Automatic sprinkler system design shall comply with the requirements of the applicable codes and the following: 1. The total demand for hydraulically designed sprinkler systems shall not exceed 90% of the available pressure and water supply. 2. Sprinkler system design including any required additional water for hose or standpipes shall not exceed the rated capacity of a fire pump used to supply the system." 9.04.090 Amendment to Section 1007.1.3 of the Uniform Fire Code. Section 1007.1.3 of the Fire Code is amended by deleting the text and adding the following: "Section 1007.1.3 General. The fire alarm system shall be tested annually and a report shall be sent to the Fire Marshal within 30 days of the test." 9.04.100 Amendment to Section 1102.4 of the Uniform Fire Code. Section 1102.4 of the Fire Code is amended by adding Section 1102.4.1.1 to read as follows: "1102.4.1.1 CAMP /RECREATIONAL FIRES. No person shall make, set or •maintain any beach or camp/ recreational fire at any place within the City except in areas where proper containers are provided for such fires by the City and where City signs are plainly posted indicating such fires are permissible." 9.04.110 Amendment to Section 7701.1 of the Uniform Fire Code. Section 7701.1 of the Fire Code is amended by adding 7701.1.1 to read as follows: "The storage of explosives and blasting agents is prohibited anywhere in the City of Newport Beach unless a permit authorizing use and /or storage has been issued by the Chief." 9.04.120 Amendment to Section 7802.1 of the Uniform Fire Code. Section 7802.1 of the Fire Code text is deleted and added to read as follows: "Section 7802.1 General. Fireworks displays shall be permitted only when authorized by, and conducted in strict conformance with, a permit issued by the Fire Chief pursuant to this Chapter." 9.04.130 Amendment to Section 7802.2 of the Uniform Fire Code. Section 7802.2 of the Fire Code text is deleted and added to read as follows: "Section 7802.2 The Fire Chief shall have the authority to seize, take, remove any fireworks stored, sold, offered for sale, used or handled in violation of the provisions of •this Code. Any seizure or removal pursuant to this section shall be in compliance with all applicable statutory, constitutional and decisional law." 9.04.140 Amendment to Section 7802.3 of the Uniform Fire Code. Delete Section 7802.3 of the Fire Code and amended the text as follows: "Section 7802.3 A. The storage, sale, offer for sale, storage or handling of fireworks is prohibited. The provisions of this Section do not apply to fireworks displays conducted in accordance with the provisions of any permit issued pursuant to this Chapter. 9.04.150 Amendment to Section 7902.2.2.1 of the Uniform Fire Code. Section 7902.2.2.1 of the Fire Code text is deleted and added to read as follows: "Section 7902.2.2.1. The storage of Class I and Class II liquids in above ground tanks outside of buildings is prohibited within the boundaries of the City of Newport Beach unless a permit authorizing use and /or storage has been issued by the Chief." 9.04.160 Amendment to Section 7902.6.3 of the Uniform Fire Code. Section 7902.6.3.1 of the Fire Code text is deleted and added to read as follows: "Section 7902.6.3.1 Location. "The underground storage of flammable liquids shall • be prohibited in any residential district or any residential area of a P-C district, as defined in Chapter 20.5 of this Code, within the City." 9.04.170 Amendment to Section 7904.4.1 of the Uniform Fire Code. Section 7904.4.1 of the Fire Code is amended by changing the text to read as follows: "Section 7904.4.1 General. Portions of properties where flammable and combustible liquids are received by tank vessels, pipelines, tank cars or tank vehicles and are stored or blended in bulk for the purpose of distributing such liquids by tank 4 vessels, pipelines, tank cars, tank vehicles or containers are prohibited within the boundaries of the City of Newport Beach except as permitted by the Chief. " 9.04.180 Amendment to Section 8001.3.2 of the Uniform Fire Code. Section 8001.3.2 of the Fire Code text is deleted and added to read as follows: "Section 8001.3.2. Hazardous Materials Management Plan. When required by the Chief, each application for a permit pursuant to this article shall include a Hazardous Materials Management Plan (HMMP) in accordance with Appendix II -E and shall contain any additional elements as required in the California Health and Safety Code, • Article I, Chapter 6.95 for Business Plan. "Section 8001.3.3. Hazardous Materials Inventory Statement. When required by the Chief, each application for a permit pursuant to this article shall include a Hazardous Materials Inventory Statement (HMIS) in accordance with Appendix II -E and shall contain any additional elements as required in the California Health and Safety Code, Article 1, Chapter 6.95 for Business Plan." 9.04.190 Amendment to Section 8202 of the Uniform Fire Code. Section 8202 of the Fire Code text is deleted and added to read as follows: "Section 8202 Permit. No person shall install or maintain a liquefied petroleum gas container, except portable containers of not more than twenty (20) gallons water capacity, unless natural gas is unavailable in the area or unless such installation is needed for special industrial process or use, unless a permit has been issued by the Chief. An application for permit shall be accompanied by plans and specifications and the Chief may impose such conditions as may be necessary to protect health, safety and welfare." 9.04.200 Amendment of Section 9001.3 of the Uniform Fire Code. Section 9001.3 of the Fire Code is amended by inserting the following to read: "The 1994 National Fire Protection Association Codes, Standards, Recommended •Practices, Manuals, Guides and Model Laws contained in the National Fire Codes, published and promulgated by the National Fire Protection Association, a copy of which is on file with the Newport Beach Fire Department." 9.04.210 Amendment to Appendix II -C of the Uniform Fire Code. Appendix II -C 6 (a) of the Fire text is deleted and added to read as follows: "Appendix II-C 6.2.1 Any portions of a float more than 150 feet from fire apparatus access or a marine service station shall be provided with an approved wet standpipe system installed in conformity with applicable standards in Uniform Building Code Standard No. 9 -2 and Fire Code Section 1004. 9.04.220 Amendment to Appendix III -B of the Uniform Fire Code. Appendix III - B of the Uniform Fire Code is deleted. In its place the City of Newport Beach Design Criteria, Standard Special Provisions & Standard Drawings for Public Works Construction, 1994 Edition, is adopted. SECTION 2. That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall • not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. 5 • SECTION 3. This Ordinance shall be published once in the official newspaper of the City and the same shall be effective 30 days after the date of its adoption.
