HomeMy WebLinkAbout189 - Vacation of Bay AvenueY5 %� 1 Resolution No. ZL • 2 3 A Resolution of the Board of Trustees of the City of Newport Beach ordering- a part of Bay Avenue, 4 an open public street in the city of Newport Beach closed, vacated and abandoned. 5 -- - - - - -- 6 7 Whereas, Bay Avenue is an open public street in the City 8 of Newport Beach and a part thereof ought to be closed, vacated and 9 abandoned, and 10 whereas, on the 17th day of April, 1922, the Board of 11 'trustees of the city of Newport B -a ch passed Resolution No. 172 0 12 declaring its intention to close, vacate, and abandon Bay Avenue in 0 Z 13 J a part; and in.said Resolution described the work and improvement, W 2 M 3 o 14 and determined that no land was necessary to be taken th °refor, and mnJ oo 15 that nodamages, costs, or expenses would accrue in making such im- d QJQ o F 16 provement; and I z m M< 17 whereas, after the passage of Resolution of Intention No. w 18 172, the Street Superintendent of the city of Newport Beech, on the v 19 18th day of April, 1922, conspicuously posted along the line of 20 said contemplatdd work and improvement, not less than 300 ft. in 21 distance apart, and six in all, notice of the passage of said Re- 22 solution of Intention No. 172, in form and manner as provided by 23 law; and also caused to be published, and there was published by 24 four successive insertions, to -wit: on the 21st and 28th days of 25 April, and the 5th, 12th, and 19th days of P;ay,1922, in NENPORT 26 NEWS, a weekly newspaper published and circuaated in the city of 27 Newport Beach and designated by the Board of Trustees for that 28. purpose, a notice similar in substance; and 29 Whereas, no person interested filed or presented amr pro - 30 test or objection., or appeared to -object or protest against the 31 work -or improvement, or against the extent of the district, and 32 I • 2 3 4 5 6 7 8 9I 10 11 0 12 z Z J 13 G w z 3 o 14 LL m m J r;U 15 z ; Q It 16 It a 0 2 Z (n a 17 m � W 18 J U 19 20 21 22 23 24 25 26 27 46 28 29 30 31 32 Z g3 7 A ii ill Whereas, ten days have expired after the date of the expiration of the time of publication of notice; Now therefore, the Board of Trustees of the city of New- port Beach do resolve and order as follows:- (1) The public interest and also the public convenience require it, and the Board of Trustees of the city of Newport Beach hereby orders That that part of Bay Avenue, a street within the boupds of the City of Newport Beach insofar as Bay Ave- nue embraces and includes the follow- ing described land, OWAP: at the northwesterly corner of Lot 13, Block 6 of a map of East Newport, as recorded in miscellaneous maps Book 3, page 37, Records -of Orange County, California; thence north 17 de- 1 grees 28 minutes east, a distance of 34.42 feet to a point in the Ares- , ent northerly boundary line of Bay Avenue as said Bay Avenue iis laid out and shown upon the aforesaid map of East Newport; thence south 72 degrees 09 min- utes east, along the northerly line of said Bay Avenue, a distance of 64.68 feet to a point; thence south 89 degrees 13 minutes east along the northerly line of said Bay Av- enue, a distance of 107.57 feet to a point, thence south 77 degrees 28 minutes east, a distance of 218.40 feet to a point in the northerly prolongation of the westerly line of 4th street; thence southerly along the northerly pro- longation of the westerly line of 4th Street to the northeasterly corner of Lot 1 of the aforesaid Block 6 of East Newport; •thence westerly along the northerly line of the aforesaid Block 6 of a map of East Newport to the place of beginning. be and the same is hereby closed, vacated, and abandoned. (2p The proposed work and improvement herein ordered done and made, being for closing in part Bay Avenue, and it appearing that no assessment is necessary, and it further appearing that no damage, cost or expense will accrue inmaking the improvement, no commissioners are required and none are appointed.
