RESOLUTION N0..3.
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE
CITY OF NEWPORT BEACH DECLARING THEIR INTENTION
TO ORDER THE IMPROVEMENT OF CERTAIN PORTIONS OF
SOUTH PROMENADE AND OTHER STREETS IN SECTION 5,
BALBOA ISLAND, WITHIN SAID CITY, UNDER THE
IMPROVEVENT ACT OF 1911, AND THE AMENDMENTS TO
SAID ACT.

The Board of Trustees of the City of Newport Beach do
resolve as follows:
SECTION I.
That the public interest and convenience require, and
it is the intention of the Board of Trustees of the City of
Newport Beach, California, to order the construction of the follow-
ing described work and improvement in said City, to -wit:
That the following streets be graded and concrete re-
taining wall be constructed in and along said streets, and also
the construction of a cement concrete sidewalk upon said streets:
(a) East Promenade of Grand Canal from the westerly pro-
longation of the southerly line of South Promenade to the north-
westerly prolongation of the northeasterly line of East Promenade,
except that no cement concrete sidewalk shall be constructed
between the westerly prolongation of the southerly curb line of
Park Avenue and the westerly prolongation of the northerly curb
line of said Park Avenue;
(b) South Promenade from the southerly prolongation of the
westerly line of East Promenade of Grand Canal to the southeasterly
prolongation of the easterly line of East Promenade;
(c) East Promenade from the easterly prolongation of the
southerly line of South Promenade to the northerly prolongation

All of the foregoing work and improvement is fully set
forth, delineated and described on plans, profiles, cross - sections

and detailed drawings No. 333-, on file in the office of the City
Engineer Of said City, heretofore approved by the Board of Trustees
of the City of Newport Beach on the_- day of /ilea- rrvXeJ ,
192.4, by Resolution No. and in further accordance with
Specifications No. 39, adopted by Resolution No. 346, and Specifi-
cations No. 4i; adopted by Resolution No. ,, of the Board
of Trustees of the City of Newport Beach, on file in the office of
the City Clerk of said City. The said plans, profiles, cross-.
sections, detailed drawings and specifications are hereby referred
to for the full and detailed description of the said proposed work
and improvement.
The grades to which the work provided for shall be done,
and the improvement made upon those portions of the streets herein -
before described, which are provided for in this Resolution, are the
grades shown on the profiles therefor on file in the office of the
City Engineer of said City, to which said profiles reference is here-
by made for the description of said grades.
For all purposes of this proceeding that certain public
street in the City of Newport Beach lying westerly of and adjacent
to Blocks 1, 7 and 8, of Section 5, Balboa Island, as per map
thereof recorded in Miscellaneous yaps, Book 8, page 9, Records of
Orange County, California, and westerly of and adjacent to the
prolongation across intersecting streets of the westerly lines of
the aforesaid Blocks, and extending from the westerly prolongation
of the southerly line of South Promenade, herein referred toy, to the
northwesterly prolongation of the northeasterly line of East

• Promenade, herein referred to, is herein referred to and designated
as "East Promenade of Grand Canalu, and the name thereof is hereby
declared to be and established as "East Promenade of Grand Canal"
and so referred to.
For all purposes of this proceeding that certain public
street in the City of Newport Beach lying southerly of and adjacent
to Blocks 1, Z, 3 and 4, of the aforesaid Section 5, of Balboa
Island, and southerly of and adjacent to the prolongation across
intersecting streets of the southerly lines of the aforesaid Blocks,
and extending from the southerly prolongation of the westerly line
of East Promenade of Gtand:.Canal, herein referred to, to the south-
easterly prolongation of the easterly line of East Promenade, herein
referred to, is herein referred to and designated as "South Promenade"

and the name thereof is hereby declared to be and established as
"South Promenade", and so referred to.
For all purposes of this proceeding that certain public
street in the City of Newport Beach lying easterly and northeast-
erly of and adjacent to Blocks 4, 5, 9 and 8, of the aforesaid
Section 5, of Balboa Island, and easterly of and adjacent to the
prolongation across intersecting streets of the easterly and north-
easterly lines of the aforesaid Blocks, and extending from the
easterly prolongation of the southerly line of South Promenade,
herein referred to, to the northerly prolongation of the westerly
line of East Promenade of Grand Canal, herein referred to, is herein
referred to and designated as "East Promenade ", and the name thereof
is hereby declared to be and established as "East Promenade", end

SECTION II.
Notice is hereby given that serial bonds to represent
unpaid assessments and bear interest at the rate of seven (7) per
cent per annum will be issued hereunder, in the manner provided

• by the Improvement Bond Act of 1915, the last installment of which
Ak bonds shall mature fourteen (14) years from the second day of July
next succeeding ten (10) months from their date.
SECTION III.
That the contemplated work and improvement hereinbefore
mentioned is, in the opinion of said Board of Txus� tees; of more
than local.or ordinary public benefit, and the expense of said work
and improvement is made chargeable upon the district hereinafter,

described, and said Board -of TAu6fEees do hereby declare said dis-
trict to be the district benefited by said work and improvement,
and to be assessed to pay the costs and expenses thereof, which
district is bounded and described as follows, to -wit:
Beginning at the intersection of the southerly prolongs -
<1',� tion of the westerly line of -East Promenade of Grand Canal and the
westerly prolongation of the southerly line of South.Promenade;
thence easterly along the westerly prolongation of the southerly
line of South Promenade, and along the southerly line of said
South Promenade, and along the easterly prolongation of the souther-
ly line of said South Promenade, to its intersection with the south-
easterly prolongation of the easterly line of East Promenade; thence
northerly and northwesterly along the southeasterly prolongation of
the easterly line of East Promenade, and along the easterly and
northeasterly line of said East Promenade, and along the northwest-
erly prolongation of the northeasterly line of said East Promenade,
to its intersection with the northerly prolongation of the westerly
line of East Promenade of Grand Canal; thence southerly along the
northerly prolongation of the westerly line of East Promenade of
Grand Canal, and along the westerly line of said East Promenade
of Grand Canal, to the place of beginning, excepting therefrom
any lands forming any part of any public street or alley.

• The above description is general only. A plat or map
of said District, No. 333, adoptdrd by Resolution No. 39 y, of
the Board of Trustees of said City, indicating by a boundary line
the extent of the territory included in the proposed district, is
on file in the office of the City Clerk. Reference is hereby made
to said plat or map for a further full and complete description of
the said assessment district. The said map or plat so on file
shall govern for all details as to the extent of the said assess-
went district.
SECTION IV.
Notice is hereby given that on Monday, the Z2" day of
zz e"r,7 6e l- 1926, at 7;30 o'clock, P.M., in the Council
Chamber of the City Hall of the said City of Newport Beach, any and
all persons having any objections to the proposed work or improve-
ment, or to the extent of the district, or both, may appear before
the said Board of Trustees and show cause why said proposed improve-
ment should not be carried out in accordance with this Resolution.
SECTION V.
The Newport News, a weekly newspaper, printed, published
and circulated in the City of Newport Beach, is hereby designated
as the newspaper in which this Resolution of Intention shall be
published, and for the publication of all other notices, resolutions,
orders or other matter required to be published by the provisions
of the Improvement Act of 1911, hereinafter referred to, and the
City Clerk of said City is hereby directed to cause this Resolution
of Intention to be published by two insertions in said newspaper
in the manner and form required by law. The Board of Trustees do
not deem it advisable that the Clerk mail copies of the notice of
improvement to owners, or reputed owners, and he is not required
to mail the same.

SECTION VI
The Street Superintendent of said City shall, after the
adoption of said Resolution of Intention, cause to be conspicuously
posted along the lin$ of said contemplated work or improvement, and
along all the open streets within the hereinbefore described a6d ess-
ment district, notices of the passage of this Resolution of Intention
in the manner and form required by law.
SECTION VII.
Except as hereinbefore stated, all the proceedings for the
aforesaid work and improvement shall be had and taken under and in
accordance with the provisions of an Act of the Legislature of the
State of Cslifornia,designated as the "Improvement Act of•1911",
approved April 7th, 1911, and Amendments thereto.
