Y 71 RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NE57PORT BEACH DECLARING THEIR INTENTION TO VACATE, CLOSE UP AND ABANDON FOR PUBLIC STREET PURPOSES A CERTAIN PORTION Or FIRST STREET AND A CERTAIN ALLEY WITHIN THE SAID CITY. The Board of Trustees of the City of Newport Beach do resolve as follows: SECTION 1. It is the intention of the Board of Trustees to order that portion of a public street and an alley, hereinafter described, within the said City, to be closed up, vacated and abandoned for public street purposes; the said portions of said streetand alley to be closed up, vacated and abandoned for public street purposes and described as follows, to wit: (a) The Westerly 40 feet of First Street extending from the Southerly line of Bay Avenue as said Bay Avenue is laid out and shown upon a map of- East Newport, as recorded in Man Book 3 page 37, records of Orange County, California, to the Northerly line of .lot Twelve (12) in Block One (.1), as laid out and shown upon said map of East Newport. (b) That certain 30 foot alley extending from the Easterly line of Island Avenue, as said Island Avenue is laid out and shown upon a map of East Newport, as recorded in Map Book 3, page 37, records of Orange County, California, to the Southerly pro- longation of the Westerly line of First Street, as said First Street • is laid out and shown upon aaid map of East Newport. Page 1. a SECTION 2. That the public work herein provided for is the closing up of the portions of the street and alley herein described in Section 1 and it appearing to the Board of Trustees that there are no costs, damages or expenses occasioned by or arising out of said work and that no assessment is necessary to pay the costs, damages or expenses of said work and that, therefore, no assessment district of lands to be effected or benefited by said work or improvement is necessary. SECTION 3. The Street Superintendent of the City of Newport Beach is hereby directed to cause to be conspicuously posted along the line of said contemplated improvement, at not more than three hundred feet in distance apart upon said street and not less than three in all upon said street, notices of the passage of this resolution, -said notice to be headed, "NOTICE OF PUBLIC PORK ", in letters not less than one inch in length and stating the fact of the passage of this resolution; its date and briefly the work of improvement proposed, being that of vacating the portion _of First Street and Alley herein described, and the said notice shall refer to this resolution for further particulars; the said Street Superintendent shall also cause a similar notice to that herein described, to be published by four successive insertions in the Newport News, a weekly newspaper, printed, published and circulated in said City of Newport Beach (there being no daily newspaper so printed published and circulated in said City). SECTION 4. The City Clerk shall certify to the passage of this Resolution and cause a minute thereof to be recorded in the minutes of the meeting of the Board of Trustees at which this resolution was passed.
