That the public interest and convenience require, and it is the intention of the City Council of the City of New- port Beach, to order the'construction of the following described work and improvement in said city, to -wit: z- 1. The erection and construction of a reinforced .r concrete bridge and all appurtenances thereto belonging, together with cement concrete piles, cement concrete approach walls, cement concrete pavement between approach walls, cement concrete steps • 1 • z 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 • 27 • 28 29 30 31 32 6 and landings, pipe hand rails, LaLux Manufacturing Company's cement concrete lighting posts and appliances, eheridized iron lighting conduit, lead covered lighting cable, cement concrete sidewalks, cement concrete sheet piles with Schlueter Interlocking System, cement concrete pipe drains, grading and appurtenances thereto, the re- location of the existing water main, the re- location of existing lighting posts and appliances and the re- location of existing conduits and cable, the removal of the existing structure or bridge, the removal of certain cement con- crete pavement, all of which work and improvement is appurtenant to the erection and construction of said reinforced concrete bridge, in, along and upon Park Avenue from a line which is 100 feet east of and parallel with the East line of urine Avenue north of Park Avenue, across the Grand Canal to a line, which line is 110 feet west of and parallel to the West line of Abalone Avenue. 2. That the following described portions of Park Avenue be graded, the existing curbs removed and existing light posts removed, the roadway thereof paved with six (6) inch cement concrete pavement, the width of said roadway to be paved ing from 10 feet to 12 feet. (a) Park Avenue from a line 110 feet west of and parallel to west line of Abalone Avenue to a line 10 feet west of and parallel to the west line of Abalone Avenue. —2�- • 1 (b) Park Avenue from the East line of Marine • 2 Avenue north of Park Avenue to a line 100 feet east of and parallel 3 to said east line of Marine Avenue. 4 3. The erection and construction of a- reinforced 5I concrete bridge and all appurtenances thereto belonging, together 6 with cement concrete piles, cement concrete approach walls, cement 7 boncrete pavement between approach walls, cement concrete s- tTasrs 8 and landings, pipe hand rails, LaLux Manufacturing.Company's cement 9 concrete lighting posts and appliances, sheridized iron lighting 10 conduit, lead covered lighting cable, cement concrete curbs, cement 11 concrete abutments, cement concrete sidewalks, bituminous macadam 12 wearing surface with gravel base, gravel shoulders, grading and 13 appurtenances thereto, the re— location of existing water main and 14 the removal of existing lighting posts and appliances and the re- 15 moval of the existing structure or bridge, all of which said work 16 and improvement is appurtenant to the erection and construction 17 of said reinforced concrete bridge, in, along and upon Marine 18 Avenue, between a line 500 feet north of and parallel to the north 19 line of Balboa Avenue and the east prolongation of the, north 20 line of North Bay.Front; in, along and upon the public right —of —way 21 across certain tide lands, between the northerly prolongation 22 of the west line of Marine Avenue and the northerly prolongation 23 of the east line of Marine Avenue, and between the easterly pro - 24 longation of the north line of North Bay Front and the U. S. 25 Government Bulkhead line, between Station 100 and Station 101, as 26 shown on a map of the survey of Newport Bay, showing harbor lines • 27 approved by Assistant Secretary of War January 18, 1917; in, along • 28 and upon the public right —of —way, across certain tide lands, between 29 a line parallel to and 30 feet east of the northerly prolongation of 30 0 � nt r the g line of Marine Avenue and a line parallel to and 30 feet 31 c t nter west of the northerly prolongation of the ^ °.al line of Marine 32 —3. • 1 • z 3 4 5 6 7 8' 9i 10 11 12 13' 14 15 16 17 18 19 20 21 22 23 24 25 26 • 27 2s 29 30 31 32 Avenue, and between the aforedescribed bulkhead line and a line parallel to and 100 feet north of the aforedescribed bulkhead line.,I�— All of the foregoing work and improvement is fully set forth, delineated and described on plane, profiles, croes- sections and detailed drawings No. 352 and No. 353 and standard plans of the City of Newport Beach No. 1001, on file in the office of the City Engineer of said city, heretofore approved by the City Council of the City of Newport Beach on the 5th day of November, 1928, by Resolution No. 4 7(0 , and in further accordance with e3 H"GJ Specifications No. 39 adopted by Resolution No. tft and Specifica- tions No. 38 adopted by Resolution No. 3M p of the City Council of the City of Newport Beach and Special Specifications No. 1 adopted by Resolution No. 474t and Specification No. 44 adopted by Resolution No. 47,!!57' of the City Council of the City of Newport Beach, and on file in the office of the City Clerk of said City. Said plane, profiles, cross — sections, detailed drawings and specifications are referred to for a full and detailed description of said work and improvement, the same as though set forth in full herein, and shall be directory as to the location of all work to be done, the kind of materials to be used and the type of construction. The grades to which the work provided for shall be done, and the improvement made upon those portions of the streets hereinbefore described, which are provided for in this Resolution, are the grades shown on the plane No. 352 and No. 353 therefor on file in the office of the City Engineer of said City, to which said plane reference is hereby made for the description of said grades, and it is hereby resolved by the City Council of the City of Newport Beach that the grade shown on the plans and profiles is the official grade to which the work herein ordered shall be done. -4.» e • 1 SECTION II. • 2 Notice is hereby given that serial bonds to re- 3 present unpaid assessments and bear interest at the rate of ^% 4 per cent per annum will be issued hereunder, in the manner pro- s vided by the Improvement Bond Act of 1915, the last installment of 6 which bonds shall mature fourteen (14) years from the second day 7 of July, next succeeding ten (10) months from their date. 8 SECTION III. 9 That the contemplated work and improvement herein - 10 before mentioned is in the opinion of said City Council of more 11 than local or ordinary public benefit and the expenses of said 12 work and improvement is made chargeable upon the district herein - 13 before described, and said City Council does hereby declare said 14 district to be the district benefited by said work and improvement 15 and to be assessed to pay the cost and expenses thereof, which 16 district is bounded and described as follows, to -wit; Schlueter of Beverly Hills, Califor- 10 ni,a, in relation to the above described work and improvement, 11 dated October 16,,1928, and on file in the office of the City 12 Clerk of the City of Newport*Beach. 13 Attention is hereby called and reference is hereby 14 made to the LaLux Manufacturing Company's Street Lighting Standards is and LaLux Illuminating Unite, Patent License Agreement of LaLux 16 Manufacturing Company„ Incorporated, of Los Angeles, California, 17 in relation to the above described work and improvement, dated 18 October 12, 1928, and on file in the office of the City Clerk of 19 the City of Newport Beach. 20 SECTION V. 21 Notice is hereby given that on Monday, the 26th 22 day of November, 1928, at the hour of 7 :30 o'clock P. M. in the 23 Council Chamber of the City Hall of the said City of Newport Beach, 24 any and all persons having any objections to the proposed work or 25 improvement or to Q extent of the district, or both, may appear be- 26 fore the said City Council and show cause why said proposed improve- , 27 ment should not be carried out in accordance with this Resolution. • 28 That all persons desiring to so appear should file 29 with the City Clerk of the City of Newport Beach before the hour 30 herein set a written protest against the said work or the assessment 31 strict proposed to be assessed or both. di P y 32 f • 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 • 27 • 28 29 30 31 321 L 6 SECTION VI The Newport News, a weekly newspaper printed, pub- lished and circulated in the City of Newport Beach, is hereby des- ignated as the newspaper in which this Resolution of Intention shall be published, and for the publication of all other notices, reso- lutions, orders or other matter m quired to be published by the provisions of the Improvement Act of 1911, and Amendments thereto, hereinafter referred to, and the City Clerk of said City is hereby directed to cause this Resolution of Intention to be published by two insertione_in said newspaper in the manner and form required by law. The City Council do not deem it advisable that the City Clerk mail copies of the notice of improvement to owners, or reputed owners, and he is not required to mail the same. SECTION VII. The Street Superintendent of said City shall, after the adoption of said Resolution of Intention, cause to be conspic- uously posted along the lines of said contemplated work or improve- ment, and along all the open streets within the hereinbefore des- cribed assessment district, noticesof the passage of this Resolution of Intention, in the manner and form required by law. SECTION VIII Except as hereinbefore stated, all the proceedings for the aforesaid work and improvement shall be had. and taken and in accordance with the provisions of an Act of the Legislature of the State of Califor na designated as the "Improvement Act of 191111, approved Aprill7, 1911, and Amendments thereto.
