RESOLUTION NO. � 7 A RESOLUTION OF THE CITY COUNCIL OF -TH23 CITY OF NEWPORT BEACH, AUTHORIZING THE TRANSFER OF CERTAIN REAL PROPERTY OF SAID CITY FOR STATE HIGHWAY PURPOSES AND AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OF SAID CITY TO EXECUTE A DEED TO THE GRANTEE ON BEHALF OF SAID CITY. WHEREAS, it satisfactorily appearing to the City Council of the City of Newport Beach that it would be for the benefit and best interests of said City of Newport Beach to grant a rightof way over and across a certain portion of real property belonging to said City for State highway purposes, whi said real property is hereinafter described; and WHEREAS, it further satisfactorily appearing to said City Couhcil that said real property hereinafter described is a small portion of a larger tract of land, and that said larger tract of land will be greatly benefited by the widening of the State Highway; and WHEREAS, said property is not any portion of any water front; and WHEREAS, the real property proposed to be granted is a small portion of a larger tract of land and the widening of said State Highway will greatly increase the value and use of the larger portion of said real property; and WHEREAS, said grant is made to the State of California, and no consideration is asked of said State of California for said grant in as much as the same will be of direct benefit to the lands of said city and generally to the City of NewportBeach. CALII. j t. property belonging to the City of Newport Beach and situate in the City of Newport Beach, County of Orange, State of California, being a portion of Lot 172 of Block 1 of the Irvine Subdivision as per map recorded in Book 1, page 88 of Miscellaneous Record Maps, Reoords of said Orange County. Said State highway right of way hereby granted, conveyed and dedicated is more particularly described as follows, to —wit. 6 strip of land 100 feet wide, being 50 feet on each side of the following described center line; commencing at a point in the westerly right of way line of the Southern Pacific Railroad Company, which point is the northeast corner of the parcel of land awarded to F. M. Strobridge, et ux., by decree of Superior Court Case No. 23686 as recorded September 19, 1928 in Book 201, page 253, of Official Records, Records of said Orange County; thence ffom said point of beginning S. 860 111 01., along the northerly line of said parcel of land, a distance of 91.94 feet; thence along a tangent curve to the right having a radius of 1500 feet, a distance of 332 feet, more or less to the westerly line of the parcel of land as deeded to the City of Newport by deed recorded in Deed Book 403, page 137, records of said Orange County. The side lines of the above described 100 foot stri of right of way shall be prolonged or shortened so as to termina in said westerly right of way line at the point of beginning and said westerly boundary line at point of ending. It is understood that the undersigned grantors grant only that portion of the above described 100 foot strip of land which is included within lands owned by said grantors or in which said grantors are interested. be transferred to the State of California and that a good and sufficient deed bey executed and delivered forthwith to the State of California by the City of Newport Beach, and the Mayor and City Clerk of said City of Newport Beach are hereby directed to execute said deed on b ehalf of said City, cbnveyirgand dedicating to the State of California the above described right of way and incidents thereto for State highway purposes.
