RESOLUTION N0. 2
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain Agreement dated the/74e-
day of 1939, by and between toe City of Newport
Beach, a municipal corporation, as party of the first part, and
E. B. Cubbon and C. E. McFarland, a co- partnership, doing busines
under the name and style of Cubbon & McFarland, as party of the
second part; and
WHEREAS, said agreement grants to the party of the
second part, the right and privilege of loading and unloading
passengers and patrons going to and from two city owned peirs
or wharfs, and located at Balboa and Newport Beach, to and from
stationary fishing barges owned by party of the second part and
which are anchored ordinarily within the three mile limit of the
shore line of the City of Newport Beach, upon certain conditions
and terms set forth in said agreement, and for the time specified
in said agreement.
NOW, THEREFORE, BE IT RESOLVED: That said agreement be,
and the same is hereby approved as written, by the City Council
of said City of Newport Beach, and the Mayor of said City and the
City Clerk of said City shall, and they are hereby authorized to
sign the same on behalf of said city, and the Clerk is directed
have the party of the second part, and each of them, execute said
agreement, and said agreement shall thereupon be filed and become
a valid agreement as between said parties.
I hereby certify that the foregoing Resolution was
duly and regularly passed by the City Council of the City of
Newport Beach at a regular meeting thereof held on the / -a-1
