J, RESOLUTIUN NO. 7�9— WHEREAS, the City Council of the City of Newport Beach did, on or about the 7th day of Apr l 1930, enter into a certain and ark Soldano agreement of license with one Fred J. Addisonlof the City of Newport Beach, wherein and whereby the City of Newport Beach and Carl $oldano granted to the said Fred J. Addison, a license for having live bait, for the purpose of sale and selling the same upon and along the deck or floor of the wharf or pier which extends into and. over the waters of the Pacific Ocean from the southerly end of Main Street, at Balboa, being the wharf erected by the funds of Municipal Improvement District No. 1; and WHEREAS, said license was granted upon the conditions, considerations and covenants of said license agreement; and WHEREAS, it is provided among other things in said license agreement aforesaid, that in the event that the said and Car, Sci4ano Fred J. Adaison'snal have at any time in the judgment of the City Council of the City of Newport Beach, failed, neglected or refused to keep, perform and carry out all of the conditions of said license agreement, according to its true intent, meaning and spirit, that the City Council of the City of Newport Beach shall have the right and power at any regular meeting or special meetin thereof, to make and cause to be entered upon the minutes of said meeting its order declaring said license terminated; and WHEREAS, the City Council of the City of Newport Beach and Carl Soldano believes that said Fred J. Addison'haVe failed to keep, perform and carry out all the terms and conditions of said license agree— went, in accordance with the true intent, meaning and spirit and Carl Soldano thereof, in that said Fred J. Addison,`haWfailed to keep the floor or deck of said wharf in a clean, wholesome, sightly and sanitary condition and free from accumulation or refuse. NOW, THEREFORE, BE IT RESOLVED: That the said Fred J. 06. ,4 1 C "% %,%I- no AddisonAhaVe neglected to perform and carry out all the terms and conditions of said license agreement heretofore mentioned, according to the true intent, meaning and spirit thereof, and has failed to carry out said agreement in the respects heretofore set forth; and BE IT FURTHER RESOLVED: That the said license agreement be, and the same is hereby terminated, and upon service of a copy *a C- %% mot,..,e of this resolution, upon said Fred J. Addison said license agree- ment and all the rights of said Fred J. Addison,`therein, shall be immediately ended, terminated and be declred of no further force or effect for any purpose whatever; and BE IT FURTHER RESOLVED: That the said Fred J. Addison o�et6a++e ^be ordered and directed to remove all fishing gear and parapher- nalia belonging to him and used in connection with said license agreement on said wharf, within five (5) days from and after the service of a copy of this resolution upon him; and BE IT FURTHER RESOLVED: II'hat if the said Fred J. Addisi shall fail to remove said fishing gear and paraphernalia, within said five (5) day period aforesaid, that the said property and all of it shall become property ofC the City of Newport Beach, and '41.1 Ce.et Oche +rl that the said Fred J. BE IT FURTHER RESOLVED 4- c� That a copy of this resolution be served by the Chief of Police of the City of Newport Beach on Cork %9116,.0 the said Fred J.Addison,,forthwith, and that he make his return of service and file the same with the Clerk of the City of Newport Beach, and at the same time that this resolution is served, that a copy of the order entered upon the minutes as aforesaid, by the Clerk of the City of Newport Beach, shall also be served upon a T4 C OA 006k s"%10 the said Fred J. Addison by said Chief of Police, and a return of service made by him thereon, and filed with the Clerk of the City of Newport Beach.
