RESOLUTION NO. %T
WHEREAS, the City of Newport Beach did on or about
the let day of October, 1931, enter into a certain agreement
or license with one George 0. Hiner of the City of Newport Beach,
wherein and whereby the said City of Newport Beach granted to
said George C. Hiner, the privilege of using the Newport Pier
under the conditions in said agreement mentioned X6zi the sum of
$3600.00, in the manner set forth in said agreement; and
WHEREAS, it now appears that the said George C. Hiner
is unable to make the payments provided for in said agreement or
license with said City of Newport Beach for the reason that he
does not derive sufficient revenue from the business conducted
by him on said pier to pay said rentals; and
WHEREAS, it is for the best interests of the City of
Newport Beach that a responsible person conduct a live bait
consession on said pier and to keep said pier in a sanitary condi
tion, and said live bait business now conducted by said George C.
Hiner, is an asset to the City of Newport Beach; and
WHEREAS, the said George 0. inner has petitioned the
City Council of the City of Newport Beach for a cancellation of
said lease and for a new lease, providing for payments of $600.00
per year, in lieu and stead of $1200.00 per year; and
WHEREAS, the City Council of the City of Newport Beach
believes that said lease should be cancelled and a new lease
entered into between the City of Newport Beach and the said
George 0. Hiner.
NOW, THEREFORE, BE IT RESOLVED: That said license
agreement dated the said let day of October, 1931, with the said
George C. Inner, be and the same is hereby cancelled, annulled a

declared of no further force or effect , as of October let , 1932;
and
BE IT FURTHER RESOLVED: that this resolution of can-
cellation of said agreement does not effect, nor is it intended
to effect the payments due under said lease to and including
September let, 1932; and said George C. Hiner shall pay all
ag r eement
delinquencies under said lease before a new shall be delivered
to him.
BE IT FWHER RESOLVED: That the Clerk of the City of
Newport Beach be authorized, directed and instructed to to sign
a cancellation of the lease herein mentioned on behalf of the
City of Newport Beach, with said George 0. Hiner, as of date
October let, 1932.
I hereby certify that the above and foregoing Resolution
was duly passed and adopted by the City Council of the City of
Newport Beach, at a regular meeting thereof, held on the 7th day
of November, 1932, by the following vote, to -wit:
