3 WHEREAS, Section 3897 -d of the Political Code of the
4 State of California, provides among other things, that whenever
5 any property has been deeded for delinquent taxes and /or assess -
6 meats to the State of California, and said property has also been
7 deeded for delinquent taxes and /or assessments to any munioipalit,
8 the governing body of said municipality may enter into an agree -
9 ment with the Board of Supervisors in the County in which said
10 property is situated, subject to the approval of the State
11 Controller, for the purchase of, or for the option to purchase th
12 property so held by the State, or any part or parts thereof; and
13 WHEREAS, more than ninety -six percent (96%) of the
14 lots in Blocks 139 to 143, both inclusive, of Resubdivision of
15 Corona Del Mar, Blocks 839 to 843 both inclusive, of Corona Del
16 Mar, and certain lots in Tract No. 383, all known by the sales
17 name of "Alta Vista by the Sea", in the city of Newport Beach,
18 County of Orange, State of California, are now delinquent for
19 county taxes and city taxes of the city of Newport Beach and
20 assessments, and two hundred seventy -five (275) of said lots have
21 been deeded to the State of California for non - payment'of city
22 taxes and assessments, all of which are past due for more than
23 five years; and
24 WHEREAS, there has this day been presented to the City
25 Council of the city of Newport Beach a plan to return to the city
26 tax rolls and to the county tax rolls all lots in Block 139,
27 except lots 10 and 21 thereof; all lots in Block 140, except
28 lots 6, 7, 8, 18 and 20; all lots in Block 141; all lots
29 in Block 142, except lots 1, 7 and 8; all lots in Block 143
30 except lots 1, 8, 11 and 17; all lots in Block 239 except
31 lots 2 and 6 thereof; all lots in Block 240 except lots

8, 9 and 10; all lots in Block 241 except lots 2 and 10; all

lots in Block 242; all lots in Block 243 except lots 9, 19 and

21, and those certain lots in Tract No. 323 as follows: Lot

2, in Block "%", Lot 2 in Block "Y ", Lot52A in Block "Z", and lot

2 in Block BB, all in the Corona Del Mar District in the City

of Newport Beach, County of Orange, State of California, all of
7
said lots being located in that certain tract known as "Alta
8
Vista by the Sea "; and

WHEREAS, there has also been presented to the City
10
Council of the city of Newport Beach, an agreement dated the

day of May, 1936, wherein the Board of Supervisors
12
of the County of Orange, State of California, acting under

the authority granted to it by 3897 -d of the Political
14
Code of the State of California, therein designated as the Seller,
15
and the City Council of the City of,Newport Beach, acting under
16
the authority granted tDit by Section 3897 -d of the Political
17
Code of the State of California, is designated as the Buyer,
18
wherein the said Buyer agrees, among other things, to purchase
19
said delinquent tea lots heretofore mentioned and more
20
particularly described in said agreement, for the sum of Two
21
Hundred Seventy -five ($275.00), cash, lawful money of the United
22
States of America, said agreement however, to be subject to the
23
approval of the State Controller of said State, and subject and
24
pursuant in all respects to Section 3897 -d of the Political Code
25
of the State of California.

NOW, THEREFORE, BE IT RESOLVED that the City Council
27
of the city of Newport Beach approves the plan this day
f 28
submitted to it for the purpose of placing said delinquent
29
tax property back on the tax rolls of the city of Newport Beach,
30
and orders the same to be attached to this resolution and filed
31
as a permanent record with the City Clerk of the City of Newport
32
Beach; and

BE IT FURTHER RESOLVED: That the City Council of the
City of Newport Beach by reference thereto, makes said plan
and the whole thereof, a part of this resolution to the same
extent and purpose as if the same were herein set out in full; and
BE IT FURTHER RESOLVED that the agreement heretofore
mentioned be, and the same is hereby approved as written, and
the Mayor of the city of Newport Beach, and the City Clerk of
said city are hereby directed and authorized to sign and execute
the same on behalf of the city of Newport Beach, and the Clerk
is directed and instructed to deliver a duly executed copy
thereof to the Seller therein named.
I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the
City Council of the city of Newport Beach at a regular meeting
thereof held on the 4th day of May, 1936, by the following
