WHEREAS, pursuant to instructions, the City Attorney

of the City of Newport Beach, has prepared a contract in which

4 the City of Newport Beach agrees to sell certain excess water
5 of said city to HEINZ KAISER, upon the conditions, covenants
6 and restrictions in said contract set forth; and
7 WHEREAS, said contract has been duly presented by the
City Attorney to the City Council of the City of Newport Beach,
8
9 for its acceptance and approval.
10 NOW, THEREFORE, BE IT RESOLVED: That that certain
11 contract made and entered into the 1st day of April, 1936, by
12 and between the City of Newport Beach, as the party of the first
13 part, and HEINZ KAISER, as the party of the second part, wherein
14 and thereby the City of Newport Beach agrees to sell certain
15 of its excess water upon certain conditions, restrictions and
limitations to said party of the second part, be and the same
16
17 is hereby approved as written.
BE IT FURTHER RESOLVED: That the Mayor and City Clerk
18
of the City of Newport Beach be authorized and directed to sign
19
said contract on behalf of the City of Newport Beach.

22 and regularly passed by the City Council of the City of Newport
23 Beach at a regular meeting thereof held on the _day of
