RESOLUTION NO.
WHEREAS, Dian R. Gardner and Adella Gardner, his wife,
assert and claim that the City of Newport Beach has no right,
title or interest in or to the real property hereinafter describ-
ed; and
WHEREAS, it is the belief and understanding of the
City Council of the City of Newport Beach that the said City of
Newport Beach does not have at this time any right, claim, inter-
est or demand in or to the real property hereinafter described;

WHEREAS, it appears that it is necessary for the said
Dian R. Gardner and Adella Gardner, his wife, in order to perfect
their title to obtain from the City of Newport Beach a quitclaim
deed to the real property hereinafter described; and
WHEREAS, the said Dian R. Gardner and Adella Gardner
have tendered to the City the sum of Five Dollars ($5.00) as and
for the consideration for a quitclaim deed to the property des-
cribed hereafter; and
WHEREAS; it affirmatively appearing to the City Council
of the City of Newport Beach that said sum of money is a fair andi,
just amount for any right, title or interest that the City might
have in and to said real property and that it is for the best I
interests of said City that said deed be given.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
City Clerk of the City of Newport Beach be, and they are hereby
authorized and directed in the name of the City of Newport Beach
to execute, sign and deliver said deed to the said Dian R. Gard-
ner and Adella Gardner, his wife, and the real property therein

1 described, which said property is more particularly described as
2 follows, to -wit:
3 All that real property situated in the City of
Newport Beach, County of Orange, State of California,
4 described as follows:
5 Lot Nineteen (19) in Block Ten (10) of "Section
3, Balboa Island ", as shown on a Map recorded in Book
61 7, page 15 of Miscellaneous Maps, records of Orange
County, California.
