WHEREAS, there has this day been presented to the
City Council of the City of Newport Beach a ce3tain Indenture
of Agreement dated the 11th day of January, 1937, by and
between the Western Union Telegraph Company, a corporation,
of the State of New York and the City of Newport Beach, a
municipal corporation of the State of California; and
WHEREAS, said Indenture specifies that the City
of Newport Beach did grant to the western Union, an easement
for a telegraph line and appurtenances along certain land
in Orange County, California, and agreed not to use such land
as to preclude the maintenance thereon by Western Union of such
telegraph line and appurtenances; and
WHEREAS, the City of Newport Beach now desires
the Western Union to relinquish and quitclaim such easement to th
city, and the Western Union is willing to relinquish and quitclai .
such easement upon certain terms and conditions in said Indenture
of agreement set forth; and
WHEREAS, the City Council of the city of Newport
Beach deems that it is for the best interests of said city that
said Indenture of Agreement be entered into.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor
and City Clerk of the city of Newport Beach be, and they are
hereby instructed to execute said agreement in the name of and
on behalf of the city of Newport Beach.
I hereby certify that the within and foregoing
Resolution was duly and regularly passed and adopted by the
City Council of the City of Newport Beach at an adjourned
regular meeting thereof held on the 11th day of January, 1937,
