CALIFORNIA r RESOLUTION NO. WHEREAS, the City Attorney of the City of Newport Beach has pursuant to instructions of the City Council of the City of Newport Beach, prepared and this day presented to the City Council of the City of Newport Beach, a certain Indenture of Lease, dated the I q t� day of April, 1937, wherein the City of Newport Beech is referred to as the party of the first part, and ORANGE COUNTY COUNCIL, BOY SCOUTS OF AMERICA, a corporation, is referred to as the party of the second part, which said lease covers all that certain real property situated in the City of Newport Beach, County of Orange, State of California, and more particularly described as follows, to —wit: A portion of Lot 171, Block 54, of Irvine's Subdivision, recorded in Miscellaneous Maps, Book 1, page 88, Records of Orange County, California, more particularly described as follows: Beginning at the most easterly corner of Lot "H" Tract 919, as laid out and shown on a map recorded in Book 29, pages 31-34 incl., of Miscellaneous Maps, Records of Orange County, California; thence South 39A 431 30" West 132.85 feet to anintersection with the United States Govern nt bulkhead Line between Station No. 129 and StatiofiN230, as shown on a map entitled "Harbor Linea, Newport Bay Harbor, California ", approved by the Secretary of War on May 2, 1936, and on file in the United States Engineerts Office, Los Angeles, California; thence South 610 OOt East along said bulkhead line a distance of 128.5 feet; thence North 290 001 East 103.65 feet, to an intersection with the boundary line of the City of Newport Beach; thence northwesterly along said boundary line to the point of beginning. And WHEREAS, in the judgment of the City Council of the City of Newport Beach it is for the best interests and welfare of said city and the inhabitants thereof that said lease hereto- fore described, be executed by said city of Newport Beach to the ORANGE COUNTY COUNCIL, BOY SCOUTS OF AMERICA; and WHEREAS, it is further the judgment of the City Council of the City of Newport Beach that it would be inimical to the best interests of said City, for said property to be leased for any other than recreational, residential, civic or educational purposes; and r - ,r 1 11 WHEREAS, it is further the judgment of the City Council • 2 I of the City of Newport Beach that the leasing of said lands to 3 Orange County Council, Boy Scouts of America, upon the conditions, 4 I specified in said lease, is not inconsistent with the trust 5 imposed upon a portion of said lands hereinbefore described 6 under the Constitution of the State of California, and that the 7 leasing of said lands is necessary for the proper development 8 of Newport Harbor and the City of Newport Beach; and 9 WHEREAS, it is further the opinion and judgment of the 10 City Council of the City of Newport Beach that the consideration 11 for said lease is fair, just and adequate. 12 NOW, THEREFORE, BE IT RESOLVED: That said lease 13 heretofore mentioned be, and the same is hereby approved as 14 written, by the City Council of the City of Newport Beach, and 15 the Mayor of said City, and the City Clerk of said City shall, 16 and they are hereby authorized and directed to sign and execute 17 the same on behalf of the City of Newport Beach, and the Clerk 18 is authorized and directed to deliver a duly executed copy of 19 said lease to the ORANGE COUNTY COUNCIL, BOY SCOUTS OF AMERICA. 20 21 I hereby certify that the above and foregoing 22 Resolution was duly and regularly passed and adopted by the City 23 Council of the City of Newport Beach at an adjourned regular 24 meeting thereof held on the 19th day of April, 1937, by the 25 following vote, to—wit: 26 AVO, COUNCIL 27� 28 NOES, COUNCILMEN: o.. -29: _.
