3 WHEREAS, the City of Newport Beach proposes to widen
4 1 Marine Avenue located on Balboa Island in the city of Newport
5 Beach; and
6 WHEREAS, deeds are being obtained for the widening
7 of said street, from the owners of properties adjacent thereto;
8 and
9 WHEREAS, these deeds are being obtained without consider -
10 ation being paid therefor, other than the benefits enuring to the
11 adjoining property owners by the widening of said street; and
12 WHEREAS, said deeds are being obtained with the full
13 understanding and agreement that the City of Newport Beach will
14 pay for the widening of said street from funds of the City of
15 Newport Beach, and through such aid as the City of Newport Beach
16 II may be able to obtain from the Federal Government for said projectl
17 II and
is WHEREAS, the grantors in said deeds request that the
19 City Council of the City of Newport Beach, by act of said City
20 Council, assure the grantors in said deeds, for the widening of
21 Marine Avenue, that they will not ask or compel the grantors
22 in said deeds to form an assessment district or pay for the
23 improvement and widening of said street, and that the funds for
24 said proposed improvement be obtained from the funds of said city
25 1 available for that purpose, and through such aid as the City
26 may be able to obtain from the Federal Government.
27 NOW, THEREFORE, BE IT RESOLVED: That all owners of
28 properties fronting on Marine Avenue, who shall deed to the City
29 of Newport Beach the necessary lands for the widening of Marine
30 Avenue, between the bridge and Park Avenue, on Balboa Island,
31 shall not be assessed for the widening of said street, or the

improvements to be made in the widening thereof; and
BE IT FURTHER RESOLVED: That a certified copy of this
resolution be delivered by the City Clerk of the City of Newport
Beach to Grainger Hyer, Attorney at Law, Balboa Island, to be
used by him in the obtaining of deeds from adjoining property
owners, for the purpose of the improvement herein mentioned.

was duly and regularly passed by the City Council of the City of
Newport Beach at a u ia f meeting thereof, held on the
