Ll � e?, WHEREAS, the City Attorney of the City of Newport Beach has pursuant to instructions of the City Council of the City of Newport Beach, prepared and this day presented to the City Council of the City of Newport Beach, a certain Indenture of Lease, dated the 1st day of November, 1937, wherein the City of Newport Beach is referred to as the party of the first part, and the NETPORT HARBOR UNION HIGHSCHOOL DISTRICT, is referred to as the party of the second part, which said lease covers all that certain real property situated in the City of Newport Beach, County of Orange, State of California, and more particularly described as follows, to -wit. "Beginning at a point in the city boundary line of the City of Newport Beach which bears South 610 001 East 128.5 Meet and North 290 001 East 103.65 feet from the most southerly corner of Lot H, Tract No. 919, as shown upon a map recorded in Book 29 of Miscellaneous Maps, Pages 31 to 34 inclusive, Records of Orange County, California; running thence South 290 001 West 103.65 feet to a point in the United States Government Bulkhead Line between Station 129 and Station 130, as shown on a map entitled "Harbor Lines, Newport Harbor, California" approved by the Secretary of War May 2nd, 1936 and on file in the office of the United States District Engineer in Los Angeles, California; running thence South 610 001 East along said bulkhead line, a distance of 100 feet; thence North 290 001 East 89.20 feet, more or less, to a point in the city boundary of the City of Newport Beach; thence Northwesterly along said city boundary to the point of beginning." 1. CALIFORNIA And WHEREAS, in the judgment of the City Council of the City of Newport Beach it is for the best interests and welfare lof said city and the inhabitants thereof that said lease hereto- fore described, be executed by said City of Newport Beach to the NEWPORT HARBOR UNION HIGHSCHOOL DISTRICT; and WHEREAS, it is further the judgment of the City Council of the City of Newport Beach that it would be inimical to the best interests of said City, for said property to be leased for any other than recreational, residential, civic or educational purposes; and WHEREAS, it is further the judgment of the City Council of the City of Newport Beach that the leasing of said lands to the Newport Harbor Union Highschool District, upon the conditions specified in said lease, is not inconsistent with the trust imposed upon a portion of said lands hereinbefore described under the Constitution of the State of California, and that the leasing of said lands is necessary for the proper development of Newport Harbor and the City of Newport Beach; and WHEREAS, it is further the opinion and judgment of the City Council of the city of Newport Beach that the consideration for said lease is fair, just and adequate., NOW, THEREFORE,BE IT RESOLVED: That said lease heretofore mentioned be, and the same is hereby approved as written, by the City Council of the City of Newport Beach, and the Mayor of said City, and the City Clerk of said City shall, and they are hereby authorized and directed to sign and execute the same on behalf of the city of Newport Beach, and the City Clerk is authorized and directed to deliver a duly executed copy of said lease to the NE PORT HARBOR UNION HIGHSCHOOL DISTRICT, I hereby certify that the above and foregoing Resolution was duly and regularly passed and adopted by the City 2. 0 t 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18- ^19 21 22 23 24 25 26 27 28 29 30 31 32 11 Council of the City of Newport Beach at an adjourned regular meeting thereof held on the 4th day of November, 1937, by the following vote, to —wit: vizy (SEAL) AYES, COUNCILMEN: a�aLm. `n; r T_ Atn NOES, COUNCILMEN: I hAa ABSENT, COUNCILMEN: LAW 0"'0"" OF II POLAND TNONIPSON FIRST NATIONAL BANK rt a ILDINC 3.
