RESOLUTION NO.

WHEREAS, A. M. ROTHGERY and ALICE S. ROTHGERY, husband

and wife, have this day offered to the CITY OF NEWPORT BEACH, the

sum of $750.00 for Lots 71 and 72, Tract No. 948, in the City of
5
Newport Beach, as shown on Map recorded in Book 30, page 7 of
6
Miscellaneous Maps, records of Orange County, California; and

WHEREAS, the said price is a fair and adequate price
as and for the purchase price of said lots; and
9
WHEREAS, the City Council of the City of Newport Beach
10
deems that it is for the best interests of said City that said
11
property be sold for the said sum of $750.00; and
12
WHEREAS, the price offered is just, fair and adequate
13
and is not disproportionate to the real value of the property
14
above described.

NOW, THEREFORE, BE IT RESOLVED: That said property
16
be sold to the said A. M. Rothgery and Alice S. Rothgery, husband
17
and wife, for the sum of $750.00, free and clear of all encumbrane

18
subject to the taxes for the fiscal year 1939 -40, and unpaid
19
improvement assessments of record. Also subject to conditions,
20
restrictions and reservations of record. The Mayor and the
21
City Clerk are hereby authorized and directed to Execute and
22
deliver a deed for said property to the said parties upon receipt
23
of the consideration above set forth.

BE IT FURTHER RESOLVED: That the sum of $32.50 be j
25
paid to Harry Hyde, and the sum of $42.50 be paid to R. C. Parker,
26
as and for their commission for the negotiating of the sale of
27
said real property to A. M. Rothgery and Alice S. Rothgery, his
• 28
wife, as joint tenants, said sum being a fair and reasonable
29
commission to be allowed in said sale and said brokers being
30
licensed realtors of the City of Newport Beach

I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the
City Council of the City of Newport Beach at an adjourned regular
meeting thereof held on the 215th day of February, 1939 by the
following vote, to -wit:
