RESOLUTION NO.

WHEREAS, JOHN H. NICHOLSON, MILDRED V. NICHOLSON and

ETHEL G. NICHOLSON, have this day offered to the CITY OF NEWPORT
4
BEACH, the sum of $1100.00 for Lots 104, 105, 106 and 107, in
5
Tract 949, in the city of Newport Beach, as shown on Map recorded
6
in Book 30, page 7 of Miscellaneous Maps, records of Orange Count
7
California; and

WHEREAS, the said price is a fair and adequate price
10
as and for the purchase price of said lots; and
11
WHEREAS, the City Council of the City of Newport Beach
12
deems that it is for the best interests of said City that said
13
property be sold for the said sum of $1100.00; and
14
WHEREAS, the price offered is just, fair and adequate
15
and is not disproportionate to the real value of the property
16
above described.

NOW, THEREFORE, BE IT RESOLVED: That said property
18
be sold to the said John H. Nicholson, Mildred V. Nicholson, and
19
Ethel G. Nicholson, for the sum of $1100.00, free and clear of
20
all encumbrances, subject to the taxes for the fiscal year 1939 -4
21
and unpaid improvement assessments of record. Also subject to
22
conditions, restrictions and reservations of record. The Mayor
23
and the City Clerk are hereby authorized and directed to execute
24
and deliver a deed for said property to the said parties upon
25
receipt of the consideration above set forth.

BE IT FURTHER RESOLVED: That the sum of $110.00 be
27
paid to Gertrude A. Waldron, as and for her commission for the
28
negotiating of the sale of said real property to John H. Nicholsc
29
Mildred V. Nicholson, and Ethel G. Nicholson, as joint tendats,
30
said sum being a fair and reasonable commission tote allowed in
31
said sale, and said broker being a licensed realtor of the City
32
I of Newport I wport Beach.

I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the
City Council of the City of Newport Beach at an adjourned
regular meeting thereof held on the 2(5th day of February, 1939,
