O I i b WHEREAS, it affirmatively appearing to the City Council of the city of Newport Beach that certain public property, to -wit, the West Newport Bathing Pool, is unsightly and unsanitary and constitutes a menace to health and comfortable enjoyment of property in that locality of the city known as West Newport; and WHEREAS, said bathing pool cannot be maintained in a sanitary and sightly condition except at a great expense to the city of Newport Beach; and WHEREAS, said public property known as the West Newport Bathing Pool is at this time needed for other public purposes and uses; and WHEREAS, it affirmatively appearing to the City Council of the city of Newport Beach that the public interest and necessity require the filling and grading to approximate street grade of said bathing pool, lying between 36th Street and 38th Street and northerly of Coast Boulevard, formerly known as Bay Avenue, as laid out and shown upon a map of River Section, Newport Beach, recorded in Book 4, page 25 of Miscellaneous Maps, Records of Orange County, California; and WHEREAS, it likewise affirmatively appearing to the City Council of the city of Newport Beach that said public proper- ty aforesaid is needed for the purpose of opening a street 25 feet) in width parallel with the northeasterly line of said bathing pool) I and extending between 36th Street and 38th Street. The center line of said street proposed to be opened is to be 27.5 feet southwesterly of the northeasterly line of said bathing pool, and that said bathing pool be further improved by the opening of 37th Street, 30 feet in width, for a distance of 25 feet southwesterly of the southwesterly line of Block 137 of said River Section, and that said street be improved between 36th Street and 38th Street LAW OFFICES OF ROLAND THOMPSON 210 SPURGEON BUILDING Page 1 SANTA ANA. CALIFORNIA a i I 1 and the southwesterly extension of 37th Street by the construction 2 of cement concrete curbs and decomposed granite roadway 20 feet 3 in width and by the construction of a storm drain from 38th 4 Street and Coast Boulevard easterly to the intersection of the 5 northeasterly side of said bathing pool and 37th Street; and 6 WHEREAS, it further affirmatively appearing to the 7 City Council of the city of Newport Beach that the property 8 hereinbefore described is necessary for the use of said city in 9 the construction and maintenance of a municipal improvement, 10 to—wit'. 11 (a) The opening of a street 25 feet in width, 12 parallel with the northeasterly line of said bathing pool and 13 extending between 36th Street and 38th Street. The center line 14 of said street to be opened is to be 27.5 feet southwesterly of 15 the northeasterly line of said bathing pool. 16 (b) The opening of 37th Street, 30 feet in width, 17 for a distance of 25 feet southwesterly of the southwesterly line 18 of Block 137 of said River Section. 19 (c) The improvement of said street between 36th 20 Street and 38th Street and the southwesterly extension of 37th 21 Street by the construction of cement concrete curbs and decomposed 22 granite roadway 20 feet in width. (d) The construction of a storm drain from 38th 23 24 Street and Coast Boulevard easterly to the intersection of the 25 northeasterly side of said bathing pool and 37th Street. 26 NOW, THEREFORE, BE IT RESOLVED: That the public 27 Interest and necessity require and it is hereby ordered that the 28 • public property heretofore described, be used for the construction 29 of municipal improvements, to —wit: 30 (a) The filling and grading to approximate street 31 grade of that certain bathing pool heretofore described. 32 LAW OFFICES OF ROLAND THOMPSON Page 2 210 SPURGEON BUILDING SANTA ANA. (c) The opening of 37th Street, 30 feet in width, for a distance of 25 feet southwesterly of the southwesterly line of Block 137 of said River Section. (d) The improvement of said street between 36th Street and 38th Street and the southwesterly extension of 37th Street by the construction of cement concrete curbs and decomposed granite roadway 20 feet in width. (e) The construction of a storm drain from 38th Street and Coast Boulevard easterly to the intersection of the northeasterly side of said bathing pool and 37th Street. BE IT FURTHER RESOLVED: That the public interest and convenience require that the work of improvement heretofore mentioned in this resolution be done as quickly as funds are a able for the purposes of improvement in this resolution mentioned.
