RESOLUTION NO. A 6 U
WHEREAS, there has this day been presented to the City
Council of the city of Newport Beach a certain agreement between
Frank L. Smith and W. S. Smith, Jr., doing business under the name
and style of Smith Brothers Boat Works, as party of the first part,
and the city of Newport Beach,as party of the second part; and
WHEREAS, said agreement provides that the party of the
first part was on the 22nd day of July, 1940, awarded the contract
by the party of the second part for the furnishing of labor and
materials in the building of a wharf at 31st Street and the build-
ing of a wharf at 'IN" Street, all in the city of Newport Beach,
Orange County, California, all in accordance with first party's
written proposal for the doing of said work and the furnishing
of said materials, which said written proposal together with the
plans and specifications for the doing of said work is attached
to said agreement and made a part thbreof; and
WHEREAS, said agreement specifically specifies the
consideration, terms and conditions under which said work shall
be done and improvement made; and
WHEREAS, the City Council of the City of Newport Beach
believes that it is for the best interests of/said City that
said contract be entered into, for the doing of said work of
improvement.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and City
Clerk of the City of Newport Beach be, and they are hereby
directed, instructed and authorized to execute said agreement
in the name of and on behalf of the city of Newport Beach.
I hereby certify that the above and foregoing Resolution
was duly passed and adopted at D meeting of
the City Council of the city of Newport Beach held on the 22nd
