RESOLUTION NO. 1JJ �
WHEREAS, there is now pending in the Superior Court
of the State of California, in and for the County of Orange,
action No. 38548, involving that certain real property
situated in the city of Newport Beach, County of Orange,
State of California, and more particularly described as follows,
to -wit:
Lots 5 and 6 in Block 240, and Lot 3
in Block 437, Canal Section, Newport
Beach, as shown on a map recorded in
Book 4, page 98 of Miscellaneous Plops,
Records of Orange "County, California.
And WBEREAS, the defendants in said action are the
record owners of said real property and also own the bonds now
a lien on said real property and issued under and pursuant to
the Improvement Act of 1911, under Resolution of Intention
No. 558 of the city of Newport Beach; and
WHEREAS, the City of Newport Beach has been offered
for all of its right, title and interest in and to said real
property the sum of $600.00; and v,
WHEREAS, the City Council of the City of Newport
Beach deems that said price is just, fair and adequate for the
interest which said city may have in said property, and that
it will be for the best interests and benefit of said city that
said City dispose of its right, title and interest in said
property in order that said property may again be placed on the
assessment rolls where it will bear its just burden of taxation.
NOW2 THEREFORE, BE IT RESOLVED; That a certain
stipulation entered into by and between the plaintiff in said
action and the defendants therein, wherein and whereby said

1 said defendants agree to pay to said city the sum of $600.00
2 and that title be quieted in them on their cross- complaint, subject,
3 however, to the matters in said stipulation mentioned, be and the
4 same is hereby approved, and the Mayor and City Clerk of the City
5 of Newport Beach are authorized, directed and instructed to approve
6 in writing the Stipulation this day presented to the City Council
7 of the City of Newport Beach, on behalf of said City of Newport
8 Beach.

11 I hereby certify that the above and foregoing
12 Resolution was duly and regularly passed and adopted by the
13 City Council of the city of Newport Beach at a regular meeting
14 thereof held on the 2nd day of September, 1940, by the following

STIPULATION
It is hereby stipulated by and between the
respective parties and their respective attorneys as follows:
I.
That the defendants and cross - plaintiffs, Ralph P.
Maskey and Irene Maskey, his wife, forthwith pay to the plaintiff
and cross- defendant, City of Newport Beach, the sum of $ 600.00
the receipt of which is hereby acknowledged by the plaintiff and
oross- defendant, City of Newport Beach.
IY.
That the defendants and oross- plaintiffs take
Judgment on their cross- complaint against the plaintiff and
cross- defendant, City of Newport Beach, quieting their title to
that certain real property described in plaintiff's complaint
and oros.s- plaintiffs' gross- complaint, and more particularly
described as follows:

under the Improvement Act of 1911, pursuant to Resolution of
Intention Ivo. 558 of the city of Zewpert Beach, and said named
defendants and cross - plaintiffs also agree to assume and pay all
installments on bonds issued under the Improvement Bond Act of
1915, pursuant to Resolution of Intention No. 621 of the city of
Nevo2ort Beach, which may becoiAe duo or pays9le in the future, it
being understood and agreed in this connection that all improveme
bonds issued pursuant to the Improvement Bond Act of 1915 and
said Resolution. of Intention Sao. 621 aforesaid, shall be paid to
date hereof, not including, however, payments to be _*wade for the
fiscal year 1940- 1941.
