HomeMy WebLinkAbout1996 - Fifth Street Improvements0 • 1 RESOLUTION NO- 3 RESOLUTION .O NG Z%PROVEMENT 4 Ciao -;z O S"i iD -3 -yo 5 WHEREAS, the City Council ofthe city of Newport Beach, 6 7 on the 5th day of August, 1940, passed its Resolution of Intention No. 1982, to order the hereinafter improvement to be 8 made and public work to be done in the city of Newport Beach; and 9 WHEREAS, after the passage and adoption of Resolution 10 of Intention No. 1982 the Street Superintendent of the city of 11 Newport Beach caused to be conspicuously posted along the.line 12 of the contemplated work and improvement at not more than three 13 hundred feet (300') in distance apart, and twenty -two (22) in 14 all, noticesof the passage of the said Resolution of Intention 15 headed "NOTICE OF PUBLIC WORK ", in the manner, form and substance 16 as required by law, and said Street Superintendent also caused 17 a notice similar in substance to be published by inserting said 18 notice for four successive times in the NEWPORT BALBOA NEWS TI14ES, 19 a semi - weekly newspaper published and oiruloated and of general 20 circulation in the city of Newport Beach, and named by said city 21 in said Resolution of Intention as the paper in which said notice 22 should appe -2r, all as appears from the affidavit of S. A. MEYER, 23 of the printers and publishers of said semi - weekly newspaper, :and 24 which affidavitm as filed in the office of the Clerk of the city 25 , G 11A of Newport Beach on the day of August, 1940, and is now on 26 file therein; and 27 WHEREAS, the Street Superintendent of the city of 28 Newport Beach commenced the posting of the notice hereinbefore 29 referred to on the 5th day of August, 1940, and fully completed 30 tho posting thereof on the 5th day of August, 1940, as appears 31 from the affidavit of JOHN A. CALIFORNIA Y. 1. a 0 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ,t. having expired after the expiration of the time of the publication of said notice within whioh protests or objections to the proposed work or improvement might be made by any person interested object- ing to said work or improvement, or to the extent of the d btriot or lands to be affected or benefited by said work or improvement and to be assessed to pay.tbe costs and expenses thereof; and WHEREAS, no person has filed written or made oral objections to saidwork or improvement or to the extent of the district or lands to be affected or benefited by said work ar improvement, and to be assessed to pay the costs and expenses thereof, or made any written objections whatsoever regarding said work or improvement; and WHEREAS, more than ten dave has expired since the publication of said notice of public work heretofore referred to and the City Council of the city of Newport Beach has now acquired jurisdiction to order the said improvement. IT IS HEREBY RESOLVED ANDORDERED that the public interest and convenience requires the work hereinafter described anri the City Council of the city of Newport Beach hereby orders the following work to be done andimprovement made in the city of Newport Beech, as follows: That the following described portion of a certain public unnamed street in the city of Newport BeL3Ch, commonly known as Fifth Avenue, be closed up and abandoned, to -wit: "That portion of the unnamed street, commonly known as Fifth Avenue, 25 feet wide, lying northerly of and adjacent to Block "K" of Tract No. 470, as said street and said block are shown on ms.3p recorded in Book 17, page 28 of Miseellaneous Maps, Records of Orange County, California, lying easterly of the northerly prolongation of a line parallel with and distant easterly 32 feet, measured at right angles from that certain tangent course in the westerly line of Lot 4 in saidBlock "K ", shown on said map of Tract No. 470, as having a bearing of South 150 24" East and a distance of 29.95 feet and lying Northwesterly of the northeasterly prolongation of that certain tangent course in the southeasterly line of s <1.id Lot 4, shown on said map as having a length of 97.92 feet." CALIFORNIA 5 1 All of which is more clearly shown on a certain map 2 approved and adopted by the City Council of the city of Newport 3 Beach for said abandonement by Resolution No. 1981, on the 5th 4 day of August, 1940. 5 That the public work and improvement to be made is for 6 the purpose of closing up and abandoning a portion of a certain 7 public unnamed street in the city of Newport Beach commonly known 8 as Fifth Avenue, as hereinbefore described, and for that reason 9 no district is ohargeablefor costs in connection therewith. 10 All of the herein proposed work shall be done in 11 pursuance of an Act of the Legislature of the State of California,) 12 designated "STREET OPENING ACT OF 18891, and amendments thereto. For further partboulare reference is hereby made to 13 14 said Resolution of Intention No.1982, which is dated the 5th day 15 of August, 1940, and on file with the Clerk of the City of .
