RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, APPROVING THE

WRITTEN REPORT OF THE CITY ENGINEER FOR
CERTAIN GRADING; FOR THE CONSTRUCTION OF
3
CERTAIN ASPHALTIC CONCRETE PAVEMENT WITH CLAY
BASE; THE RECONSTRUCTION OF CERTAIN CEMENT
4
CONCRETE PAVEMENT; THE RECONSTRUCTION OF
CERTAIN CEMENT CONCRETE CURB; THE INSTALLATION
8
OF CERTAIN SANITARY HOUSE CONNECTION SEWERS
AND APPURTENANT WORK IN CERTAIN ALLEYS AND

PORTIONS OF STREETS IN SECTIONS 1, 2, 3, 4 AND
5 OF BALBOA ISLAND, AND TRACT NO. 742 OF

BALBOA ISLAND IN THE CITY OF NEWPORT BEACH,
CALIFORNIA, HERETOFORE ORDERED PREPARED BY

THE CITY COUNCIL ON AUGUST 5, 1940, AND FIXING
THE TIME AND PLACE FOR HEARING OF SAID ENGINEER'S

WRITTEN REPORT UNDER THE PROVISIONS OF THE
"SPECIAL ASSESSMENT, INVESTIGATION, LIMITATION
10
AND MAJORITY PROTEST ACT OF 1931 ".

WHEREAS, the City Council of the City of Newport Beach,
13
California, did on the 5th day of August, 1940, instruct the
14
City Engineer of said City to procure and prepare a written
15
report, pursuant to Sections 2 and 3 of the "Special Assessment,
16
Investigation, Limitation and Majority Protest Act of 1931 ",
17
as amended, and thereafter the City Council has by Resolution
18
No. 2037, determined in general the nature, location and extent
19
of the proposed improvement; also generally defined the boundar-
20
ies or extent of the district or lands to be specially assessed
21
to pay the cost thereof, or any part of such cost, and defined
22
the statute under which it is proposed to conduct the proposed
23
proceedings; and that thereafter the City Engineer of said City
24
presented to this City Council the said written report;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
26
OF THE CITY OF NEWPORT BEACH, CALIFORNIA, AS FOLLOWS:

1. That the written report presented by the City

Engineer and herein referred to, is hereby approved, and it
29
is ordered that the same be filed in the office of the City
30
Clerk for public inspection.

2. That the said City Council hereby fixes Monday,
32
the 6th day of January, 1941, at the hour of seven - thirty (7:30)

o'clock P.M. as the day and hour, and the Council Chamber in the
City Hall in the City of Newport Beach, California, as the place
of hearing on the Engineer's written report, and hereby orders
such hearing to be held by the City Council of the City of
Newport Beach.
PASSED AND ADOPTED by the City Council of the City of
Newport Beach, California, at a regular adjourned meeting
thereof held on the 18th day of November, 1940, by the following
vote, to -wit:
AYES; Councilmen , /4/4 -✓
NOES: Councilmen
ABSENT: Councilmen c�

I HEREBY C E R T I F Y that the above and foregoing
