I ID�t -� RESOLUTION ORDERING WHEREAS, the City Council of the City of Newport Beach on the 28th day of April, 1941, passed its resolution of intention No. 2164, to order the hereinafter improvement to be made and public work to be done in the City of Newport Beach; and WHEREAS, after the passage and adoption of resolution of intention No. 2164 the Street Superintendent of the City of Newport Beach caused to be conspicuously posted along the line of the contemplated work of improvement at not more than three hundred (300) feet in distance apart, and twelve (12) in all, notices of the passage of said Resolution of Intention, headed "NOTICE OF PUBLIC WORK," in the manner, form and substance as required by law, and said. Street Superintendent also caused a notice similar in substance to be published by inserting said notice for four successive times in the NEWPORT BALBOA NEWS TT-KVQ a semi. - weekly newspaper published and circulated and of general circulation in the city of Newport.Beach, and named by said City in said Resolution of intention as the paper in which said not._ should appear, all as appears from the affidavit of S. A. HuM1O1Nc $NNTA ANA, CA.1. 0 75 said notice within which protests or objections to the proposed work of improvement might be made by any person interested objecting to said work of improvement, or to the extent of the district or lands to be affected or benefited by said work.of improvement and to be assessed to pay the costs and expenses thereof; and WHEREAS, no person has filed written or made oral objections to said work of improvement or to the extent of the district or lands to be affected or benefited by said work of improvement, and to be assessed to pay the costs and expenses thereof, or made any written objections whatsoever regarding said work of improvement; and WHEREAS, more than ten (10) days has expired since the publication of said notice of public work heretofore referred to and the City Council of the City of Newport Beach has now acquired jurisdiction to order the said improvement. IT IS HEREBY RESOLVED AND ORDERED that the public interest and convenience requires the work hereinafter described and the City Council of the city of Newport Beach hereby orders the following work to be done and improvement made in the City of Newport Beach, as follows: That the following described portion of the alley known as "The Arcade" in the City of Newport Beach be closed up and abandoned, to -wit: All that certain portion of The Arcade, as laid out and shown upon a map of Tract No. 814, recorded in =_: 24, page 36, Miscellaneous Maps, records of Orange County, California, described as follows, to -wit: Beginning at the southeasterly corner of Lot 14, as shown upon said map of Tract 814; running thence northerly along the westerly line of said The Arcade to the northeasterly corner of Lot 11, of Tract 814; thence easterly along the southerly line of Lot 2 of said Tract 814 to the most westerly corner of Lot 3 of said Tract 814 ; thence southeasterly along the ,southwesterly line of said Lot 3 to the most sou�"rl corner of said Lot 3; thence southerly along the erly line of said "The Arcade" to an intersection wi the easterly prolongation of the southerly line of , Lot 14; thence westerly along the last mentioned _ prolongation of the southerly line of said Lot 14 the point of beginning: 2. t 11 21 3 4 5 6 . 7' 8, 9 10 11 12 13 14. 15 16 17 18 19 20 21 22 23 24 25 26 27 28` 30 D. •�31" 32 LAW OFFICE$ OF ROLAND THOMPSON P105PUHGEON BVILOING SANTA AN F. All of which is more clearly shown on a certain map approved and adopted by the City Council of the City of Newport Beach for said abandonment by Resolution No. 2163 on the 28th day of April, 1941. That the public work and improvement to be made is for the purpose of closing up and abandoning _a portion of "The Arcade" in the City of Newport Beach as hereinbefore described, and for that reason no district is chargeable for costs in connection therewith. All of the herein proposed work shall be done in pursuance of an act of the Legislature of the State of California, designated "Street Opening Act of 1889," and amendments thereto. For further particulars reference is hereby made to said Resolution of Intention No. 2164, which is dated the 28th day of April, 1941, and on file with the Clerk of the City of Newport Beach. The Clerk of the City of Newport Beach is herewith instructed to record a certified copy of this Resolution Ordering Improvement in the office of the County Recorder of the County of Orange, State of California. I hereby certify that the foregoing Resolution Ordering Improvement was duly introduced and regularly passed and adopted by the City Colxncil of the City of Newport Beach at an adjourned regular meeting thereof held on the 19th day of May, 1941, by the following vote, to —wit: Oitf Clerk AYES, COUNCILMEN: I e NOES, COUNCILMEN: �a Qije, 3.
