RESOLUTION NO.
WHEREAS, there is now pending in the Superior Court
of the State of California, in and for the County of Orange,
IIaction No. involving that certain real property situated
in the City of Newport Beach, County of Orange, State of Califor
and more particularly described as follows, to —wit:
Parcel 1. Lots Seven (7), Eight (8) and Nine (9)
in Block Forty —six (46) of "River Sec-
tion, Newport Beach;" as shown on a
Map recorded in Book 4, page 25 of Miscellaneous
Maps, records of Orange County, California.
Parcel 2.n Beginning at the North —east corner of
Lot Nine (9) in Block Forty —six (46)
of "River Section, Newport Beach,"
as shown on a map recorded in Book 4, page 25 of
Miscellaneous Maps, records of Orange County,
California; t ence Westerly along the Northerly
line of said lock 46 to the North —west corner
of Lot Seven 17) in said Block Forty —six (46);
thence along the North — easterly prolongation of
the North — westerly line of said Block Forty —six
(46), to its intersection with the line of ordinary
high tide of the Pacific Ocean in Newport Bay
as described in the Decree recorded-Seotember
19th, 1928, in Book 201, page 253 of Official
Records and designated therein as "South Line;"
thence Easterly along said tide line to its inter-
section with the North — easterly prolongation of
the South — easterly line of Lot Nine (9) in said
B1ock'Forty —six (46); thence Southwesterly along
said Northeasterly prolongation to the point of
beginning.
And WHEREAS, the defendants in said action are the
record owners of said real property; and
WHEREAS, the City of Newport Beach has been offered
for all of its right, title and interest in and to said real
property the sum of $90.00; and h
WHEREAS, the City Council of the City of Newport Beach

deems that said price is just, fair and adequate for the interest
which said City may have in said property, and that it will be
for the best interests and benefit of said City that said City
dispose of its right, title and interest in said property in order
that said property may again be placed on the assessment rolls
where it will bear its just burden of taxation.
:50wd, THEREFOI:q, BE IT RESOLVED: That a certain
stipulation entered into by and between the plaintiff in said
action and the defendants therein, wherein and whereby said de-
fendants agree to pay to said City the sun of $;10.00 and that
title be quieted in them on their cross- complaint, subject, however
to the matters in said stipulation mentioned, be and the same is
hereby approved, and the I.1ayor and City Clerk of the City of
Newport Beach are authorized, directed and instructed to approve
in writing the Stipulation this day presented to the City Council
of the City of Newport Beach, on behalf of said City of Newport
Be ach .
I hereby certify that the above and f®regoing resolution
was duly and regularly passed and adopted by the City Council of
the City of Newport Beach at a regular meeting

cross - complaint, and more particularly described as follows, to -ail:

of California, described as follows, to -Wit:

Uap recorded in Boob 4, page 25 of Lisoellaneous
Zaps, records of orange County, California.
Parcel 2. Beginning at the northeast
corner of Lat Hine (9) in Block
Forty -six (46) "of."River.Seotion,
Newport Beach" as shown on a
map 'recorded in Book 4, page b of Niscellaneous
naps, records of Orange County, California; thence
Vlesterly along the gortherly line of said Block 46
to the Korth -nest corner of Lot Seven (7) in said
Block Forty -six (46); thence along the North- easte;
prolongation of the Worth - westerly line of said
Block Forty -six (46), to its intersection with the
line of ordinary high tide of the Pacific Ocean in
Heaport Bay ae'described in the Decree recorded
September 19th, 1928 in Book 2019 page 253 of
Official Records and designated therein as "South
Line"; thence FAsterly along said tide line to its
intersection with the Worth- easterly prolongation

said described property and that the plaintiff and cross - defendant,
City of Newport Beach, has no right, title or interest therein,
except taxes for the fiscal year 1941 -89420 and that said property
is subject to all bonds due or delinquent or which may become due
or delingquent, issued under improvement Act of 1911, and said
named defendants and oross- plaintiffs also agree to assume and pay
all installments on bonds issued under Improvement Bond Act of
1915, which may become due or payable in the future, it being
