On motion of Councilman �a;ge. ,duly seconded and

carried, the folloting Resolution was adopted:

:iHErtEAS, the Comity of Orange now owns, maintains and operates
7
a Police Broadcasting Station KGHX in the City of Santa Ana, California
8
and

and is desirous of having saitie maintained under a licensed supervising

technician of the County of Orange,

NO.�T, ThEREFORE, BE IT RESOLVED AND ORDERED by the City Council of

the Ci oi0FNEWPORTBEACR in regular session duly asse:ibled, that the

Orange, for the estaolishment, maintenance and operation of a Police
17
Broadcasting Reuoce Control Station, upon the following terms and
18
conditions, to -r,it:

1. The County of Orange agrees to install any changes or replace -
20
ments and maintain the Police Broadcasting Remote Control Station here -
21
tof ore installed in said Ci %T)61bF'NEWPnR!r4W— W to be operated by a
22
telephone line connection between said Remote Control Station and
23
Police Broadcasting Station KGHX, under the rules and regulations of
24
the Federal Co:,hmuni cat ions Co-,n,aission. All work and expense of install -
25
ation and maintenance, except expense and cost of equipment, materials,
26
apparatus and parts, shall, be borne by the County of Orange, All

equi,:�ment, material, apparatus and parts required for installation,
maintenance, replacements and repairs shall be furnished by and at the

expense of the said City 01 oplya wra_ , and in accordance with
the specifications of the County of Orange.
2. The County of Orange agrees to furnish a licensed supervising,
technician, and said Remote Contro IStation shall be under the suoer-
vision of se%id licensed technician, v.-ho shall -:;e a radio teleohhone
I operator first class.
'2 That a telephone line connecting said Remote Control Station with
3 the Police Broadcasting Station KGHX shall be rented by the County
4 and it is further understood and agreed tint the rental charge for
5 said telephone line shall be borne by the County of Orange.
6 4. Said Remote Control Station or point shall be in continous
7 connection with the Broadcasting room of Station KGHX and the City
8 Police Officers of the said Ci y fOPNE_po 13 shall be permitted

9 to broadcast over the air at any tine the Station or lines argnot
10 actually bibing used for other police agencies of Orange County utilizing
11 said Station.
12 5. It is further agreed and understood that any message of local
13 origin or importance shall have preference over "All Point Messages",
14 and the facilities for broadcasting shall be immediately surrendered to
15 such use upoli demand. Emergency calls always have preference.
16 In case of a dispute over priority of emergency messages originating in
17 two depart - cents, the operator of Station KGHX shall be the final authori
18 in deciding which emergency message shall have priority.

19 6. The said Ci�NEW�.. _ proposes to use said Station
20 fox such purposes as may be permitted by the Federal Communications
21 Commission. The operator on duty at Station KGHX shall monitor all
22 broadcasting and shall have the authority to take said Remote Control
23 Station off the air should any rule or regulation of the Federal
24 Communications Coaaunission or Federal Cortinissions Act be violated.
25 The operator of Station KGHX shall have no control over the broadcast
26 from the Police Department of the s�,,id City Io OF NEwpne4, r except
27 as explicitly set Cfo rth herein.
28 7. The said Cit Ogz� grees that so long as this
29 agree;nent remains in effect said Ciry �s'�lCITY OF NFV1/ ,, F,p�L)j;not
30 apply to the Federal Communications Commission for a license or
31 individual authority to operate a municipal Police Radio Transmitting
32 Station, and the said City of CITY OF NEWPORT BEACWhereby agrees to

accept Radio Police Service over and through Radio Police Station
RGHX, as herein agreed upon.
S. All radio equipment on mobile equipment shall be installed
and maintained by the County. Said City shall furnish all material
and supplies for installation and :maintenance on said mobile equipment.
9. This agreement may be cancelled by either party upon six
i months notice given to the other party hereof.
