RESOLUT ION N0. ``�a r, WHEREAS, there is now pending in the Superior Court of the State of California, in and for the County of Orange, action No.'3 16 gyp, and being action entitled, "City of Newport Beach, etc., vs. Earl W. Stanley, et al., ", involving that certain real property situated in the City of Newport Beach, County of Orange, State of California, and more particularly described as follows, to —wit: That portion of Lot 6 of Section 28, and Lot 2 of Section 33, in Township 6 South, Range 10 West, San Bernardino Base and Meridian, described as: Beginning at a point, which point is at the intersection of a line 100 feet easterly of and paralle ith the easterly line of Block 425 of a Map of ncaster's Addition to Newport Beach, as per map thereof recorded in Book 5, at page 14, of Miscellaneous Maps, Records of said Orange County, and the Southerly line of 28th Street, as said 28th Street is described in Ordinance No. 153, adopted by the board of Trustees of the city of Newport Beach, California, July 14, 1919; thence North 890 15' 30" East, 395.85 feet to a point; thence South 270 30" East 230.31 feet to a point; thence South 890 151 30" West 574.40 feet to a point; thence North 20 0-54' 30" East, 218.85 feet, more or less, to the place of beginning. - And WHEREAS, the defendant, Earl W. Stanley, in said action, is the record owner of said real property; and WHEREAS, the City of Newport Beach has been offered for all of its right, title and interest in and to said real property the sum of $2500.00; and WHEREAS, in addition to said $2500.00 and as part of the consideration offered,thesaid defendant, Earl W. Stanley has also agreed to deed to the city of Newport Beach by proper instrument in writing, and for easement purposes, the Westerly fifty (50) feet of the above described real property, which form of deed duly executed by the said Earl W. Stanley and wife, has this day been presented to the City Council of the City of Newpo Beach for its approval and acceptance; and 1 WHEREAS, as further consideration for the right, title 2 and interest in and to said real property of said City of Newport 46 3 Beach, the said Earl W. Stanley has agreed to pay to Roland 4 Thompson as and for his attorney's fees in this action, the sum of 5 0115.00; and 6 WHEREAS, the City Council of the City of Newport Beach 7 deems that said price is just, fair and adequate for the interest 8 which said city may have in said property, and that it will be 9 for the best interests and benefit of said city that said city 10 dispose of its right, title and interest in said property in order 11 that said property may again be placed on the assessment rolls 12 where it will bear its just burden of taxation. 13 NOW, THEREFORE, BE IT RESOLVED: That a certain 14 istipulation entered into by and between the plaintiff in said 15 action and said defendant, Earl W. Stanley, wherein and whereby 16 said defendant agrees to pay to said city the sum of $2500.00, 17 and further has agreed to give to said City of Newport Beach a 18 deed of easement to the westerly fifty (50) feet of the above 19 described property, and has further agreed to pay the attorney's 20 fees incurred in said action to Roland Thompson, plaintiff's 21 .attorney, in the sum of $115.00, and that title be quieted in {i 22I him on his cross— complaint, subject, however, to the matters in sa 23 stipulation mentioned, be and the same is hereby approved, and 24 the Mayor and City Clerk of the City of Newport Beach are authoriz directed and instructed to approve in writing the stipulation this 25 day presented to the City Council of the city of Newport Beach, on 26 behalf of said City of Newport Beach. 27 28 • I hereby certify that the above and foregoing resolution 29 Iwas duly and regularly passed and adopted by the City Council of 30 31 32 LAW OFFICER OF RO"NO THOMPSON 210 SP"CEON BUIWJ re RAHTA AHA.
