RESOLUTION NO. I A"
WHEREAS, it affirmatively nearing to the City Council of
the city of Newport Beach that the public interest and necessity
require the acquisition of an easement in and over the real
property hereinafter described, for the purpose of constructing
a bulkhead or seawall with anchor piles and tie rods, for the
purpose of protecting public and private property in the city of
Newport Beach, and that the property described hereafter is
necessary for the construction of said bulkhead or seawall.
NOW, THEREFORE, BE I ^1 RESOLVED by the City Council of the
City of Newport Beach, that the public interest and necessity
require, and it is hereby ordered that the following acquisitions
for the purpose of obtaining an easement for the construction of
a bulkhead or seawall in the city of Newport Beach, County of
Orange, State of California, be made, to —wit, the acquisition of
an easement in and over that certain real property situated in
the city of Newport Beach, County of Orange, State of California,
and more particularly described as follows, to —wit:
Parcel 1. All that portion of Lot uk ", as shown upon
a map of Tract No. 518 recorded in Book 17
of Miscellaneous Flaps, pages 33 to 36 in-
clusive, records of Orange County, California, lying
between the easterly prolongations of the northerly and
southerly lines of Lot 5 in Block "P" of said Tract No.
518.
Parcel 2. All that portion of Lot "A4 ", as shown upon
a map of Tract No. 518 recorded in Book 17
of MiscellaneousIa-os, lying between the
easterly prolongations of the northerly line of Lot 11
in Block "P" of said Tract No. 518, and the southerly
line of Lot 9 of said Block "P ".
BE IT FURTHER RESOLVED: That the City Attorney of the
City of Newport Beach be, and he is hereby ordered and directed
to bring an action in the name of the city of Newport Beach, in
the Superior Court of the State of California, in and for the

County of Orpnge, for the condemnation of the property necessary
to be taken for the acquisition herein ordered, and heretofore
described, and to do all things necessary to prosecute said action
to final determination.
BE IT FURTEM RESOLVED: That the public interest and
convenience require, and it is hereby ordered that the city of
Newport Beach, a municipal cor..oration of the sixth class,
plaintiff in said condemnation action, take immediate possession
and use of the property herein ordered to be acquired, upon
complying with the requirements of law applicable thereto, and
that the said City Attorney re „ort to this City Council the
amounts of money required therefor, as soon as the same can be
ascertained.
BE IT FURThER RESOLVED: That said action for condemnation
of said property so to be acquired shall be taken in accordance
with Section 14 of Article 1 of the Constitution of the State of
California.
I hereby certify that the above and foregoing Resolution
was duly passed, adopted and approved by the City Council of the
Cit of Newport Beac a regular meeting thereof held on the
