RESOLUTION NO. �
WHEREAS, there has this dap been presented to the
i
City Council of tae city of Newport Beach a certain agreement
between the Pacific Electric Railway Company, a corporation, in
said agreement referred to as "Railway ", and the Cite of Newp-)rt
Beach, a municipal corporation of the State of California, in
said agreement referred to as the "City "; and
WHIRr,AS, said agreement provides for a stipulated
award in the event said City shall condemn a certain right of
wa,, for exclusive use of the City, which right of way lies
between two roadways of Central Avenue in the city of Newport
Beach between McFadden Place and "R" Street; and
Wim,REAS, said agreement further provides for the
transfer of certain property to the city in the event said
award agreed upon shall be paid; and
WHEREAS, said agreement further provides, in the event
said award is paid, for the granting of certain privileges for
the re— setting of Railway's poles, wires and attachments, and
further provides that any decree of condemnation shall have in
it certain provisions therein stipulated to; and.
WHEREAS, it is the opinion and judgment of the City
Council of the city of Newport Beach that said agreement is in
all respects fair and just and that the consideration for said
right of way is a fair and just consideration; and
WHEREAS, it is further the judgment and opinion of the
City Council that it is for the benefit and best interests of said
City that said agreement as presented be executed and carried into
effect.
NOW, THEREFORE,BE IT RESOLVED: That it is for the best
interests and benefit of said city of Newport Beach that said
agreement herein referred to be executed, and the Mayor and City

Clerk of the city of Newport Beach be, and they are hereby
directed, instructed and authorized to execute said agreement
in the name of and on behalf of the city of Newport Beach, en d
that the City Clerk deliver a duly executed copy thereof to the
"Railway ".
I hereby certify that the above and foregoing
resolution was duly and regularly passed and adopted by the
City Council of the city of Newport Beach at an adjourned
regular meeting thereof held on the 16th day of June, 1941,
bar the following vote, to —wit:
