S PURSUANT TO THE PROVISIONS OF SECTION 2 OF THE "SP°CIAL ASSESS'_riEDTT INVESTIGATION, LIYITATIOTT kAD T:iAJORITY PROTEST ACT OF 1931." ooc WHEREAS, the City Council of the City of Newport Beach, California, did heretofore instruct the City Engineer of said City to procure and prepare a written re;oort pursuant to Sections 2 and 3 of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931," as amended, and thereafter the City Engineer of said City presented to the said City Council the said written report; and WHEREAS, pursuant to the provisiorsof Section 2 of the said act, the City Council must by resolution or ordin- ance determine in general the nature, location anf extent of the proposed acquisition; also generally define the boundar- ies or extent of the district or lands to be specially assessed to pay the cost thereof, or an,T part of such cost, and to det- ermine the statute under which it is proposed to conduct the proposed proceedings; T ?M7, THER FORE, BE IT R 'SOLVED BY THE CITY COT`NCIL OF TIE CITY OF N ",1POF.T PEACH AS FOLLOV!S! (1) That the proposed acquisition mentioned in the title of this resolution is more particularly described as follows: R PARCEL .Tj 1. All that portion of that certain strip of land sixty (60) feet in width situate in the City of Newport Beach, County of Orange, State of California, conveyed to the Los Angeles Inter - Urban Railway Company by deed recorded in Book 103, page 356 of Deeds, Orange County Records, lying easterly of the east- erly line of that certain 100 foot right of way of the Southern Pacific Railroad Company, as described in Deed from James Mc- Fadden to Santa Ana and Yeiwroort Railway Company, recorded in Book 78, page 399 of Deeds, Orange County Records, said strip of land being more particularly described as being thirty (30) feet on each side of the follorrin7 described surveyed center- line of the Pacific Electric Railway Company's property, to -wit; Beginning at the intersection of the center line of that certain sixty(60) foot strip of land "First" described in Reso- lution forming a part of that certain deed from the Nei�roort Beach Company to the Los Angeles Inter -Urban Railway Company, recorded in Book 103, page 356, of Deeds, Orange County Records, with the easterly line of that certain one hundred (100) foot right of way of the Southern Pacific Railroad, as described in deed from James McFadden to Santa Ana and Newport Railway Co- e mpany, recorded in Book 78, page 399, of Deeds, Orange County S6 iee i, Mo+2 a 1055 Records; thence South 290 501 East along said center line ^to Railway Survey Station 323 + 06.46 of the surveyed center line of the former Los Angeles Inter -Urban Railway, said last ment- ioned station being at the beginning of a 50 tapered curve to. the left; thence southeasterly along said 50 tapered curve to the left, eleven hundred thirty and sixty -seven hundredths (1,130.67) feet to Railway Survey Station, 334 t 37.13 of the said surveyed center line, said last mentioned station being at the end of the 50 tapered curve to the left; thence South -2- i 80° 22t East, on a line parallel to and fifty(50) feet north- erly from the southerly line of Central Avenue,'South Drive, f as shown on a map of Section IB', Newport Beach, recorded in feet to Railway Survey Station 340 + 22.47 of the said sur- 1.59410 fry veyed center line, containing AA@L&Acres more or less, of land.
