WHEREAS, there is now
pending
in the Superior Court of the

State of California, in and
for the
County of Orange,
action No.

39957 , being entitled,
"City of
Newport Beach vs.
Ralph P.

Maskey, et ux. ", involving
that certain
real property
situated in
7
the city of Newport Beach,
County of
Orange, State of
California,
g and more particularly described as follows, to -wit:
9 Lots 4 and 5 in Block 239, Canal Section,
Newport Beach, as shown on a map recorded
10 in Book 4, page 98 of Miscellaneous L4aps,
Records of Orange County, California.

12 And WHEREAS, the defendants in said action are the record
13 owners of said real property and also own the bonds now a lien
14 on said real property and issued under and pursuant to the
15 Improvement Act of 1911, under Resolution No. 558 of the City of
16 Newport Beach; and
17 WHEREAS, the City of Newport Beach has been offered for all
18 of its right, title and interest in and to said real property the
19 sum of p350; and
20 WHEREAS, the City Council of the City of Newport Beach
21 deems that said price is gust, fair and adequate for the interest
22 which said city may have in said property, and that it will be
23 for the best interests andbenefit of said city that said city
24 dispose of its right, title and interest in said property in order
25 that said property may again be placed on the assessment rolls
26 where it will bear its gust burden of taxation.
27 NOW, THEREFORE, BE IT RESOLVED: That a certain stipulation
28 entered into by and between the plaintiff in said action and the
29 11 II defendants therein, wherein and whereby said defendants agree to
30
pay to said city the sum of t�350, and that title be quieted in
them on their cross - complaint, subject, however, to the matters

In said stipulation mentioned, be and the same is hereby approved.,

and the Mayor and City Clerk of the city of Newport Beach are
authorized, directed and instructed to approve in writing the
stipulation this day presented to the City Council of the City
of Newport Beach, on behalf of sasl.City of Newport Beach.
I hereby certify that the above and foregoing resolution
was duly and regularly passed and adopted by the City Council
of the cite of Newport Beach at a regular meeting thereof held
on the 6th day of October, 1941, by the following vote, to. -rit:
