RESOLUTION NO. 0 �
WHEREAS, there is now pending in the Superior Court
of the State of California, in and for the County of Orange,
Action No. 39843, and being action entitled, "City of Newport
Beach, etc., vs. Horace Parker, et al. ", involving that certain
real property situated in the City of Newport Beach, County of
Orange, State of California, and more particularly described
as follows, to —wit:
Lot 19 in Block 11, of "Section 4, Balboa Island ",
as shown on a map recorded in Book 7, page 37 of
Miscellaneous Maps, Records of Orange County,
California.
And WHEREAS, the defendants, Horace Parker and Leverne
Parker, his wife, in said action, are the record owners of said
real property; and
WHEREAS, the City of Newport Beach has been offered for
all of its right,title and interest in and to said real property

the sum of S' Off} ; and
WHEREAS, as further consideration for the right, title
and interest in and to said real property of said City of Newport
Beach, the said Horace Parker and Leverne Parker, his wife, have
agreed to pay to Roland Thompson as and for his attorney's fees
in this action, the sum of $100.00, which sum shall include
service fees and cost of title report on the above described
property; and
WHEREAS the City Council of the City of Newport Beach
deeds that said price is just, fair and adequate for the interest
which said city may have in said property, and that it will be for
the best interests and benefit of said city that said city
dispose of its right, title and interest in said property in order
that said property may a gainie placed on the assessment rolls
where it will bear its just burden of taxation.

NOW, THEREFORE, BE IT RESOLVED: That a certain
stipulation entered into by and between the plaintiff in said
action and said defendants, Horace Parker and Leverne Parker,
his wife, wherein and whereby said defendants agree to pay said
city the sum of 0 , and further agree to pay the
attorney's fees incurred in said action to Roland Thompson,
plaintiff's attorney, in the sum of $100.00, which said include
costs of title report and service fees in said action, and that
title be quieted in them on their cross— complaint, subject,
haever, to the matters in said stipulation mentioned, be and the
same is hereby approved, and the Mayor and City Clerk of the
City of Newport Beach are authorized, directed and instructed
to approve in writing the stipulation this day presented to
the City Council of the city of Newport Beach, on behalf of the
said City of Newport Beach.
I hereby certify that the above and foregoing resolution
was duly and regularly passed and adopted by the City Council
of the city of Newport Beach at a regular meeting thereof held
on the 6th day of October, 1941, by the following vote, to —wit:
