RESOLUTION NO. a a
WHEREAS, the City Council ofthe City of Newport Beach
did on or about the 19th day of February, 1940, by Resolution No.
1763, agree to sell to Dr. Ralph D. Hoard and Jeanne B. Hoard,
husband and wife, as joint tenants with the right of survivorship,
the following described property situated in the City of Newport
Beach, County of Orange-, State of California, and more parti
described as follows, to —wit:
Lot 11, Block 3, Balboa Tract, in the City of Newport
Beach, as shown on map recorded in Book 4, page 11 of
Miscellaneous gaps, Records of Orange County, California;
And WHEREAS, the purchase price of said property was
the sum of $1000, payable as follows: 450.00 on the acceptance
of the contract, and the balance at the rate of $50.00 or more
per month, commencing as of March 15, 1940, with interest at the
rate of 6% per annum, payable semi — annually; and
WHEREAS, the said Dr. Ralph D. Hoard and Jeanne B.
Hoard, his wife, have paid on account of said contract the sum
of 8 and
WHEREAS, said purchasers, Dr. Ralph D. Hoard and Jeanne
B. Hoard, his wife, are unable to make said payments as provided
for in said contract, and desire that the moneys which they have
paid on account thereof be refunded to them; and
WHEREAS, the City Council of the city of Newport Beach
believes that it is for the best interests of said city that said
contract be cancelled and the moneys heretofore paid by said
purchasers be refunded to them; and
WHEREAS, it is further the belief of the City Council
of the City of Newport Beach that the value of said property so
sold to Dr. Ralph D. Hoard and Jeanne B. Hoard, his wife, is at
this time in excess of the purchase price thereof, to —wit, $1000.
NOW, THEREFORE, BE IT RESOLVED: That upon the said

Dr. Ralph D. Hoard and Jeanne B. Hoard, his wife, surrendering
to the City of Newport Beach said contract, and signing a
cancellation thereof, In form this day presented to the City
Council of the city of Newport Beach, the Mayor and City Clerk
of the city of Newport Beach be, and they are hereby instructed,
directed and authorized to execute said cancellation of contract
in the name of and on behalf of the City of Newport Beach.
I hereby certify that the above and foregoing resolution
was duly and regularly passed and adopted by the City Council of
the city of Newport Beach at an adjourned regular meeting thereof
held on the 18th day of August, 1941, by the following vote,
to-wit:
