RESOLUTION NO. d
3 WHEREAS, the City Council of the city of Newport Beach

did by written agreement dated the ; �t day of 1940,
5
grant to C. E. McFarland and Harold Rupp a license for the purpose
6
of having live bait for sale and selling the same upon that certain
7
city owned pier located in the city of Newport Beach, and which
8
extends into the waters of the Pacific Ocean opposite Main Street
9
in that portion of the city of Newport Beach known as Balboa; and
10
WHEREAS, said licensees have not complied with the terms
11
and condition of said written license agreement aforesaid and
12
heretofore identified in any respect, and have abandoned the use
13 of said pier for the purposes for which said license was granted
14 to them; and
15 WHEREAS, in the judgment of the City Council of the City
16 of Newport Beach the said licensees, 0. E. McFarland and Harold
17 Rupp, have failed, neglected and refused to keep, perform and
I8 carry out the conditions of said license agreement heretofore
19 referred to according to the true intent, meaning and spirit

thereof, and have failed to make the payments therein provided for.
NOW, THEREFORE, SIT RESOLVED: That said license agreeme t
dated the 1.c day of t 1940, between the city of
Newport Beach and C. E. McFarland and Harold Rupp, be, and the same
is hereby terminated and an order of termination is hereby ordered
spread on the minutes of the City Council.
BE IT FURTHER RESOLVED that a copy of said order
terminating said license agreement be served by the Chief of
Police of the city of Newport Beach, on the said C. E. McFarland
and Harold Rupp, and upon the service of said order on said named
licensees, they shall remove all improvements and equipment
belonging to them from said pier within five (5) days from and aft
the service of said order upon them as aforesaid, and in the event

of the failure of said parties to do so, then all gear,
paraphernalia and other personal property belonging to them
shall immediately from and after five days have elapsed after
the service of said order, become the property of said of the
City of Newport Beach in accordance with the terms and provisions
of said license agreement aforesaid.
I hereby certify that the above and foregoing resolution
was duly and regularly passed and adopted by the City Council of
the city of Newport Beach at a regular meeting thereof held on the
3rd day of November, 1941; by the following vote:
