RESOLUTION NO.
WHEREAS, the owners of bonds issued by the City of
Newport Beach under the Improvement Bond Act of 1915 and amendments
thereto, designated Series "D" and "G" respectively, issued pursuant
to Resolutions Nos. 304 and 370 of the city of Newport Beach,
respectively, have agreed with the City of Newport Beach that said
bonds and the interest coupons thereto attached may be surrendered
to the City of Newport Beach upon the payment by the City of
Newport Beach of a sum equal to 50% off the face value of said bonds
exclusive of interest coupons, and upon said surrender being made
that the owners of said bonds relieve and release the City of
Newport Beach from all responsibility or liability for further
payment thereon, either of principal or interest coupons.
NOW, THEREFORE, BE IT RESOLVED: That the City
Treasurer of the City of Newport Beach may pay from the Property
Fund established by the City of Newport Beach, a sum equal to
50% of the face or par value of said bonds, exclusive of interest,
upon said bonds being surrendered to said City Treasurer, and
said City Treasurer is authorized, directed and instructed to
receive from said Bondholders the mzrrender of said bonds aforesaid
together with a full and complete written release of all responsi
ity and liability in so far as the City of Newport Beach, its
officials, servants, agents and employees are concerned, in
relation to said bonds or the interest coupons thereto attached,
all in accordance with the form of release attached to this
resolution and made a part hereof.
I hereby certify that the above and foregoing
resolution was duly and regularly passed and adopted by the City
Council of the City of Newport Beach at a regular meeting thereof
