WHEREAS, CLARENCE McCULLOCH and GARNET VIRGINIA

4 M6CULLOCH, husband and wife, have this day offered to the CITY
OF NEWPORT BEACH, the sum of $125.00 for Lots leand 2, Block 21,
5
6 First Addition to Newport Heights, as shown on a Map recorded in
7 Book 4, page 94 of Miscellaneous Maps, records of Orange County,
8 California; and
9 WHEREAS, the said price is a fair and adequate price
10 as and for the purchase price of said lots; and
11 WHEREAS, the City Council of the City of Newport Beach
12 deems that it is for the best interests of said City that said
13 property be sold for the said sum of $125.00; and
14 WHEREAS, the price offered is just, fair and adequate
15 and is not disproportionate to the real value of the property
16 above described.
17 NOW, THEREFORE, BE IT RESOLVED: That said property be
18 sold to the said Clarence McCulloch and Garnet Virginia McCulloch,
19 husband and wife, for the sum of $125.00, freeand clear of all
20 encumbrances, subject to the second half of the taxes for the
21 fiscal year 1941 -42. Also subject to conditions, restrictions
22 and reservations of record. The Mayor and the City Clerk are
23 hereby authorized and directed to execute and deliver a deed
24 for said property to the said parties upon receipt of the
25 consideration above set forth.
26 BE IT FURTHER RESOLVED: That the sum of $12.50 be paid
27 to Louis W. Briggs, as and for his commission for the negotiating
28 of the sale of said real property to Clarence McCulloch and
29 Garnet Virginia McCulloch, his wife, as joint tenants, said sum
30 being a fair and reasonable commission to be allowed in said sale,
31 and said broker being a licensed realtor of the City of Newport
32 Beach.

I hereby certify that the above and foregoing Resolution
was duly and regularly passed and adopted by the City Council of
the City of Newport Beach at a regular meeting thereof held on
the 2nd day of March, 1942, by the following vote, to -wit:
